This indenture made and entered into this forth day of
December Anno domini one thousand eight hundred and forty six between Joel
Gregory of the county of Smith and State of Tennessee of the one part and Berry
West of the county and state aforesaid of the other part witnesseth that the
said Joel Gregory for an in consideration of the sum of three hundred and
eighty dollars to him in hand paid by the said Berry West the receipt whereof
is hereby acknowledged before the signing and sealing of these present hath
this day bargained and sold and by these presents doth give grant bargain and
sell convey release and confirm unto the said Berry West a certain tract or
parcel of land situated lying and being in the county of Smith and state
aforesaid on the north side of Cumberland River and west side of the Defeated
Creek and butted and bounded as followers to wit beginning on two sugar trees
Miles West northwest corner running north across the hollow to the top of the
hill thence westwards with the backbone of the ridge round until you come to
the west of the beginning thence east to the beginning so as to take in all the
falling in waters of said hollow together with all woods waters mines minerals
hereditaments appurtenances and containing twenty five acres be the same more
or less to have and to hold the said land and granted premises with all woods
waters mines minerals hereditaments appurtenances and unto the said Berry West
his heirs and the said Joel Gregory for himself his heirs and will always
warrant and forever defend the said land and granted premises from all and
every person or persons claiming or lawfully claim the same or any part thereof
but to the only proper use and benefit and of the said Berry West his heirs and
in testimony or law hereof the said Joel Gregory hath hereunto set my hand and
affix my seal this day and date first above written signed sealed and delivered
in the presents of us the subscribing witnesses.

Then the within deed of conveyance was procured in
open court for probate and was duly proven in open court by the oaths of
Sampson McClellan and Drury A. West subscribing witnesses to the same and on
motion ordered to be certified for registration copy from the minutes.
