According to Thomas Parlow’s book, Smith County Tennessee Deed Book N-U, page 237, Daniel Smith sold William Arnett 37 ½ acres on 1 December 1849. 

 

A copy of the original deed was obtained from the Tennessee State Library and Archives.

[NOTE:  the text just above and below the original deed uses the same structured language and helped in transcribing some words that were hard to read.]

 

What is significant?  (1)  In 1849, Daniel Smith sold William Arnett 37 ½ acres [on Dixon’s Creek?] (2)  A Daniel Smith was the minister at William Arnett’s church [Mt. Tabor Baptist Church.]  Is this the same person?

 

A [18 Aug 2001] transcription of the text follows:

 

 

     This indenture made and entered into this the first day of December in the year of our Lord one thousand eight hundred and forty-nine between Daniel Smith of the one part and William Arnett of the other and _____ of the State of Tennessee and Smith County _____ that the said Daniel Smith for and in consideration of the sum of one hundred dollars to him in hand paid the receipt whereof _____  _____  _____ before the _____  sealing and delivering of these _____ hath bargained and conveyed unto William Arnet a certain tract or parcel of land containing thirty-seven and a half acres being and lying in the County of smith and State of Tennessee _____on the waters of the [dry?] [part?] of dixon’s Creek and _____ as follows (to wit) beginning on a _____ and black walnut area on the east boundary of a tract of land claimed by the heirs of _____ [Palmers?] and running hence east fifty-five poles to a birch and dogwood and hence north one hundred and nine poles to a dogwood and two _____ hence west fifty-five poles to a _____ on the above mentioned lod line hence south-west said old line to the beginning with is [herediton__?] and appertances to him his heirs and _____ to have and to hold said tract or parcel of land and said Daniel Smith does warrant and forever deferred the right of said tract of land to the said William Arnet and his heirs against all lawful claims as witnessed whereof I have hereunto set my hand and seal this day and date above written.
