Ballard, Wiley Deceased
Be it remembered that I Wiley Ballard of the County of Rutherford and
State of Tennessee. Considering the uncertainty of this mortal life and being
of sound and perfect mind and memory blesses be Almighty God for the same
do make and publish this my last will and testament in manner and form following
(that is to say) that I give and bequeath unto my beloved wife Tabitha Ballard
one bed stead with a bed and furniture. I do also give and bequeath unto
my daughter Rebecca Ballard one bed stead with a bed and furniture. I also
give unto my daughter Rebecca one cow the choice of my stock and lastly it
is my will that all my property both real and personal be sold to the highest
bidder and all my just debts punctually paid it is then my will that all
the ballence of the effects of the sale with all the money on hand including
all that is justly owing to me be equally divided between my beloved wife
Tabitha Ballard and all my legal heirs. It is also my will and I do hereby
appoint my beloved friend James C. Fathered sole executor of this my last
will and testament hereby revoking all former wills by me made. In witness
whereof I have her unto sit my hand and seal the 6th day of April in the
year of our Lord 1847

and at his presence have hereunto subscribed our names as witnesses to the
same J. Stroop Junat Jesse Brasher Junat Recorded June the 6th 1854 State
of Tennessee Rutherford County Court June Term 1854 The execution of the
within last will and testament of Wiley Ballard deceased was duly proven
in open court at the above mentioned term by the oaths of John Stroop and
Jesse Brashear subscribing witnesses thereto and was ordered to be recorded.

A settlement made with Jas C Fatherd Executor of Wiley Ballard Dec. By one
John Jones Clerk of the Rutherford County Court. I find said Executor is
indebted to said Estate as per amount of sale list and Inventory of
same for notes

Ballard, Wiley, Ded.
We the undersigned being appointed for the June term of Court commisioners
to set apart to Tabitha Ballard widow of Wiley Ballard deceased one year's
provisions out of said W. Ballard's estate after being duly qualified we
agreed that she should have the following articles to wit the present lot
of bacons which we suppoed to be 25 lbs, 2 hogs, 5 lbs of corn, and that
there should be bought for her benefit 50 lbs of beef, 6 bushels of wheat,
1 bushel of salt, 20 lbs of coffee & 25 lbs sugar.
