A Declaration
         In order to obtain the benefit of an act of congress passed July 4th 1838 granting half pay and Pensions to certain Widows.
State of Tennessee Carroll County
         Personally appeared Nancy Finley before me Cantaul B. Rayers, an acting justice of the peace in and for said County and made oath in due form of law in order to obtain the benefit of an act of congress passed July 4th 1838 granting half pay and Pensions to certain widows. That she is the widow of William Finley a private in the Army of the Revolutionary War that he served three campaigns as a substitute once a volunteer and declared That he was in the battle of Germantown and Brandywine, that he then resided in the State of Maryland, and was a part of his time under General Wayne. That she does not remember his officers names though she has often heard him speak of them and other officers of the Army so that she now cannot say the particular officers under whom he served that she thinks his discharges was left in Baltimore together with other papers as she was informed that she was not married to the said William Finley during his service but was married to him on the 15th day of August 1789 and therefore have to depend on her recollection of his Wards for information.
         That her marriage took place prior to the 1st day of January 1794, to wit at the time above stated.
         That she then resided on Holsten River near the line of what was then called new Virginia and Tennessee.
         That she now does not know whether the place of her marriage was in Virginia or Tennessee after the time was established as she together with her husband shortly afterwards moved to Robertson County in the State of Tennessee, that she is illiterate and has to depend entirely on her recollection for dates only her husband placed the date of her marriage with him in a book kept by him to which she has reference for dates but the facts set forth of her own knowledge she will remembers that she is seventy-six years of age the 5th day of October last. She further declares that she well remembers that she was not quite sixteen years of age when she was married, and must depend on the rolls of the War department for positive proof of service.
         That she has been a widow ever since her husband’s death. Who died on the 17th day of February 1815 and is now a widow. Sworn to and subscribed to before on this 4th day of April 1850.

         I Cantrel B. Rogers an acting justice of the peace in and for said County do certify Nancy Finley at?? Subscriber to the forgoing declaration was duly sworn and did subscribe to the same that she is unable to attend Court by reason of old age and other infirmities. I further certify that she is a woman of good character and undoable veracity that she is personally known to me that she is a woman of good mind considering her age.

Rogers an acting Justice of the peace do hereby certify that a Dictionary titled Dyche’s Dictionary purporting to be the records of the marriage and ages of William Finley and Nancy Finley the subscriber to the foregoing declaration was duly examined by me and the leaf cut out with my own hands as it stood. Also the letters purporting to the date of the printing on the Title pages is in letters as follows viz MDCCLXXVII. Given under my hand and seal the 4th day of April, 1850 C.B. Rogers {JP}

         I Young W. Allen clerk of County Court of said County do hereby certify that William H. Carson and Cantrial B. Rogers Esqurs whose names appears to the foregoing certificates are and was acting Justices of the Peace at the time of signing the same. Duly Elected commissioners and qualified and that there signatures is given as such full faith and credit is due and ought to be given to all of these official acts. In testamony where of I have hereunto set my hand and affixed the seal of said Court at office in the Town of Huntingdon this 13th day of April AD 1850. Y.W. Allen Clerk of Carroll County Court.

         Personally appeared William Finley aged fifty nine years the 23rd day of January last before me Cantreal B. Rogers an acting justice of the peace in and for said County and made oath in due form of law that the leaf purporting to be the records of the Marriage of William Finley and Nancy Tredway was the property of his father and that on page the 2nd is in the handwriting of his father William Finley now deceased and the reason why he knows it to be so is that he has often seen his father write and that the leaf is extracted from an old Dictionary called Dyche Dictionary and that the date purporting to be the date of the printing is in letters MDCCLXXVII.
         That said dictionary has been in his possession ever since his death, which took place on the 17th of February 1815. Also the records purporting to be the ages of his children is in his fathers hand write except the age of Richard of which he is not positive in whose writing it is and that the same has been considered the true record of their marriage that on page 1st the first or two ___ lines is in her fathers Will; and Wm Finleys hand writing.
         And he further declares that he heard his father say that he served three campaigns and was in the battle of German Town and at the battle of Brandy Wine and he believes that he served part of his time under General Anthony Wayne that he thinks that he served a part of his time under Sullivan as he was a great favorite with his father the other officers he cannot remember although he well remembers to have been a soldier of the Revolution and his father William Finley most and heard both speak of their service together but his name he now cannot remember the length of the terms of service he cannot now remember that Nancy Finley the subscriber to the foregoing declarations is his mother, that he believes that she is a woman of sound mind considering her advance age and being illiterate at the same time that she has been a widow ever since the death of her husband and is now a widow.

State of Tennessee Carroll County          Personally appeared William Birch aged about fifty-seven year before William H. Carson an acting justice of the peace in and for said county and made oath in due form of law that he is personally acquainted with Nancy Finley and William Finley deceased, that they lived together as man and wife that William Finley was reputed as a Revolutionary Soldier the reason why he remembers that he was such that he William Birch substituted in the place of John Birch and was about leaving home together with his son William Finley for the Army of the United States and William Finley deceased stated to me that he had rendered considerable service in the Revolutionary War that he advised __ not to take five l__ghs to revisit places and side of the lines of the Army that it was always believed that William Finley did render service in the War of the Revolution that he was a man of good character and undiluted veracity that he died in the winter of the battle at New Orleans which he believes was in 1815, that he has been acquainted with Nancy Finley who applies for a Pension that she is a woman of good character and undoubted truth, that she has been a widow ever since the death of her husband and is now a widow. Sworn to and subscribed before me the 6th day of April AD 1850.

Supplemental Declaration for Widows Pension Revolutionary Claim

         On this 8 day of December AD 1862, Personally appeared Nancy Finley widow of William Finley deceased. Who first being duly Sworn according to law says on her oath that He yet continues the evidence of said William Finley and was married to the said William Finley at the time set forth in a previous declaration by her that her husband served as set forth in said declaration, that her agent informs her that he has made deligent search for the record that her agents name is Robert H. Hawthorne, by letters of inquiry and has been answered by the clerk’s of several Counties, knowing that Counties might have been directed said believing that no ___ records exists, she pray that her family record be admitted as evidence of her marriage already filed in the pension office under the Act of Congress 1838, that she has none of her husbands original discharges that she depends on the rolls of the Maryland line for proof of his service as a soldier of the Revolutionary War, that she believes he served three tours, one of these tours as a substitute that from the first evidence all ready filed in the Pension Office she prays that it may be admitted as evidence of proof of marriage together with her family record and the several Muster Rolls of the Maryland line, that for the sake of identity she has been informed that her husband the aforesaid William Finley was detailed from the Army to make cannon carriages, all of which she believes is true. Sworn to and subscribed to the day and date above written.

         I C.B. Rogers a justice of the peace in and for said county do hereby certify that Nancy Finley the subscriber to the foregoing declaration is a woman of unde__ble veracity and good mind considering her advance age, that she was duly sworn and did subscribe her name that she is the identical woman who filed a former declaration and was sworn to before and she yet is disabled to attend court from old age, that she is personally known to given under my hand this 8th day of December 1852.

         On this 8 day of December AD 1852 personally appeared Robert H. Hawthorn before me C.B. Rogers a justice of the peace in and for said County says on his oath that he has written several letters, and directed them to Sullivan County, Ten, and in adjoining counties directed to the County Court clerks and has received several answers which he believes were genuine from the past month. All of which stated there were no such record in his office in Clerk office that from the letters to does not believe any such public record exists from the fact that he knows from many counties in the State of Tennessee that many marriages has existed that never was recorded that from his long acquaintance with Nancy Finley and her family she has no doubt of her marriage at the time ___ first by her and that he has been requested with the family of her before the __page of the ___ law before of 1838 under which she Nancy Finley claims and he has and before the passage of said law well understood that William Finley the husband of Nancy Finley had served in the Revolutionary War, all of which he believes ___ General character but he does not know the facts of ___ knowledge but believes __ to be so that he has tried to procure a copy of the marriage license between William Finley and his wife widow Nancy Treadway, but has been informed that no such record exists. All of which he believes to be true. Sworn to and subscribed to this day and date above written.

Rogers whose name appears to the foregoing Affidavits and certificates is a justice of the peace within and for said County duly commissioned and sworn & that he was such at the ___ time of ass___ing the same that the signatures purporting to be his are genuine and that County Court of the County is a court of record.          On this 25 day of July AD 1853 personally appeared before me Hulda Ridley a justice of the peace within and for said County duly authorized by law to administer oaths for general purposes Nancy Finley a resident of said County. Who first being duly sworn according to law says on her oath that she is the identical woman who petitioned or had a declaration made by her to place her on the Pension Roll of the United States under the Act of 1838 as the widow of William Finley who she believed severed two or three tours in the Maryland troops that she has often heard her said husband say that he was in the line as a common soldier, and was called off to go and make cannon Carriages for the use of the American Army that she has no record proof of his service in the Revolutionary War, that she depends on the Muster Rolls of the Maryland troops for proof of her husbands military service, that he William Finley has said husband resided in the Town of Baltimore when he entered the service and was a wagon maker by trade, that she has no record proof of her marriage except a family record already sent to the Pension office, that she does not believe that any public records exists of her marriage because she is informed by her agent Robert H. Hawthorne that he had sent to Sullivan County where her said marriage took place, that he had received a certificate from the Clerk of the Court showing there were no such record in his office, that she has good cause to believe his information to be true, that her dependence for proof of Marriage is on the family record ___ on file in the pension office together with her reputation already on file as aforesaid. Sworn to and subscribed the day and date above written.

         On this 25th day of July AD 1853 Personally appeared before me H.H. Ridley a justice of the peace in and for said County Robert H. Hawthorne who being duly sworn according to law says on his oath that he acted as the agent of said Nancy Finley the subscriber to the above affidavit to aid her in procuring proof to place her on the pension Roll of the United States that he ___ a letter directed to the clerk of the County Court of Sullivan County and received a certificate in answer purporting to be from the clerk of the County Court of said County that he placed the same in the mail ___ directed to the Commissioners of Pensions that he has addressed two letters since directed to said Clerk and received no answer that he has been acquainted with Nancy Finley above named about twenty-four years, that she was then a widow that he had always from that time understood from hearsay that her husband (whom he never saw) to have served in the Revolutionary War. Sworn to and subscribed the day and date above written.

Ridley a justice of the peace in and for said County do hereby certify that Nancy Finley was duly sworn and did subscribe her name as a ___ that she is yet from old age unable to attend court that Robert H. Hawthorn is personally known to me and was duly sworn and did subscribe his name and is a credible witness and (I further certify) that her children are regarded as legal heirs and that she is a woman of good character given under my hand as justice of the peace this 25th day of July AD 1853.

         We send you the additional evidence in the case of Nancy Finley showing you the no record of a public nature can be obtained the __ said partner Hawthorn took the evidence first and has taken ___ to get the record if any existed but was informed by the Clerk of the County Court of Sullivan County Tenn that no death record was in his office and affidavits before them was mailed and before said certificate was mailed directed to the Pension office and yet none was ever recorded in your office. Although variance pension agents in Washington DC to place the claimant on the Pension Roll in Writing to Mrs. Finley that they have so__ and examined her claim and can obtain it. We have their letters.

         Enclosed we send you some additional proof in the case of Mrs. Nancy Finley. We hope that it will be sufficient to admit the family record of William Finley to be evidence. It is very hard to get the clerks to certify properly for few of them understands the requisitions, And technecalities of the law and in what way to make every point clear. Please refer to Jacob Smothers case for land Warrant as we have sent to you a certificate from the Clerk of the County Court. Specifying that Wm. D. Haywood was a justice of the peace for a long time. And the certificate attached to Wm. Smothers claim refereed to the g---s of Wm. Haywoods signature if it will no do pa__t act the objection you will please paint? Out the objection why you do not __ the Warrant for Thomas Mathews had.

         I received a communication from the Hon. J. G. Harris MC informing me of your inability to find the claims of several Claimants. In order to give the necessary explanation I hope you will pardon a long letter there being several Cases. They are not rejected claims or on the pension roll. I call them suspended claims for the want of attention from the former Pension commissioner.

         Mrs. Nancy Finley’s filed her declaration last March and depends on the Muster Rolls to satisfy you that her husband served in the Revolutionary War in the Maryland line his residence was at Baltimore. If you cannot find proof enough on the Muster Rolls of his residence to justify you to grant her a stipend, she cannot prove any thing more then she has proved except from heresay and please examine and decide her case. Also Mrs. Finley’s husband drew no pension but died before the pension act was passed J.E. of 1832.

         This Office is not in possession of the slightest proof that the husband of Nancy Finley of Tenn ever performed a day’s service in the War of the Revolution. I Hav__t the case will be permitted to rest upon our suspender files until some effort is made to supply the proofs often required, in the various letters written to you upon the subject.
