         (Note: The first date of 1840 is the date the children of John Payne made the division of his land. It appears they waited until after the death of their mother Elizabeth, to register and take possession of the lands.)

John Payne & others to W. L. Payne 30 June 1846
         This Indenture made this 29th day of December in the year of our Lord, one thousand eight hundred and forty, between Sarah Johnson, Samuel H. Bailey and his wife Rebecca, John Payne of the County of and State of Tennessee and Elizabeth Crawford, Joseph Payne, Seaton H. Turner and his wife Dosha of the County of Sumner and State aforesaid, Simpson Payne of the County of Marshall and State of Mississippi by his attorney in fact Daniel Mulloy, Mary Norvell of the County of Macoupin and State of Illinois by her attorney in fact Daniel Mulloy and James Vaught and his wife Phebe of the County of Logan and State of Kentucky of the first part and Warren L. Payne of the County of Robertson and State of Tennessee of the second part. Witnesseth, that the said Sarah Johnson, Samuel H. Bailey and his wife Rebecca, John Payne, Seaton H. Turner and his wife Dosha, Elizabeth Crawford, Joseph Payne, Simpson Payne, Mary Norvell and James Vaught and his wife Phebe for and in consideration of the sum of three hundred dollars by the said Warren L. Payne to them in hand paid, the receipt and payment whereof is hereby acknowledged hath given, granted, bargained, sold, conveyed and confirmed by these presents unto the said Warren Payne his heirs and assigns forever, a certain tract & parcel of land, Situated, lying and being in the County of Robertson and State of Tennessee, on the waters of red river, and District No. 1 and lot No. 2. Beginning at a post oak and a pointer the N. E. corner of Lot No. 1 running East seventy poles and nine links to two black oak saplings in the North boundary line of the Wm Beaumon Survey, thence South two hundred and fifty poles to a small post oak and black oak shrub on the south boundary line of said Wm Beaumon's survey. Thence West seventy poles and nine links to a post oak & pointers, the South East corner of Lot No. 1, thence North two hundred and fifty poles to the Beginning. Containing one hundred and ten acres, To have and to hold the same to the said Warren L. Payne his heirs and assigns forever, We do covenant and bind ourselves our heirs and representatives to warrant and defend the title of said land to the said Warren L. Payne his heirs and assigns forever against any claim to be made by ourselves or any person claiming through or under us but no further.          You are hereby authorized & empowered to take the examination of Phebe Vaught. Dosha C. Turner the feme coverts privately and apart from their said husbands relative to their free execution of the within deed and the same so taken certify under your hand and seal Witness Joseph E. Winfield clerk of the County Court of Robertson at office this 16 day of 1846.

         Phebe Vaught and Dosha C. Turner feme covert having personally appeared before me and having by virtue of the authority in me vested, been examined privately & apart from their husbands James Vaught & S. H. Turner and they having acknowledged the due execution of the within deed by them freely voluntarily without compulsion coercion by their said husbands, the same is therefore certified. Witness my hand and seal this 18th day of April 1846.

         Personally appeared before me Joseph E. Winfield clerk of the County court for said County Erastus Payne one of the subscribing witnesses to the within named deed on the 14 day of Sep, 1845, who being first sworn depose and say that he is acquainted with James Vaught, S. H. Bailey, Elizabeth Crawford, Sarah Johnson, Seaton H. Turner & Joseph Payne the within named bargainers, and that they acknowledged the same in his presence to be their act and deed upon the day it bears date, also personally appeared before Erastus Payne, Franklin Johnson for the purpose of proving the hand writing of John Johnson one of the subscribing witnesses to the within named deed, who being first sworn depose and say, that they were acquainted with John Johnson in his lifetime also his handwriting and that the signature purporting to be his are in his own handwriting and that the said John Johnson has departed this life, also personally appeared before me, Daniel Mulloy attorney in fact for Simpson Payne & Mary Norvell two of the within named bargainers with whom I am personally acquainted & who acknowledged that he executed the within deed for the purposes therein contained this on 2 June 1844, and also appeared before me Rebecca Bailey the feme covert, in the within named deed being also privately and apart from her husband the Samuel H. Bailey acknowledged the execution of said deed to have been done by her freely voluntarily and understandingly without compulsion or restraint from her said husband and for the purposes therein contained this done on 14 Sept 1845. Witness my hand at office 2 June 1846.
