This Deed of Conveyance, Witnesseth: Whereas, Lena M. Strain, being the owner of the land hereinafter described and a resident of Robertson County, Tennessee, died on November 16, 1933, after having made her last will and testament, which instrument appears of probate in the County Court of said county and state in Will book No.33 at Page No.77, under an order of probate entered in Minute Book No.43 at Page No.22 of said court: and, Whereas, said testatrix devised the land hereinafter described to her husband, L.L. Strain, in fee title, with an executory devise over to W.W. Gilbert and H.G. Gilbert should said L.L. Strain die without bodily heirs: and,
Whereas, said L.L. Strain died on May 20, 1958, without bodily heirs, issue or children having been born to him; and,
Whereas W.W. Gilbert died on May 28, 1949, survived by his wife, Pearl Gilbert, and one child and sole heir at law, Helen Gilbert Smith, who is sui juris and twenty-one years of age.
Now, for the consideration of Nine Thousand, Two Hundred and Twenty-five ($9,225.00) Dollars, cash in hand fully paid, the receipt of which is acknowledged, we, H.G. Gilbert, Helen Gilbert Smith and Pearl Gilbert, hereinafter called the grantors, have bargained and sold and do sell, transfer and convey unto John Robert Rippy, hereinafter called the grantee, heirs and assigns, the particular tract of land situate in the 2nd. Civil District of Robertson County, Tennessee, described to-wit:
Beginning at a stone in the Cross Plains Road, in the line of the Dr. J.T. Spain land, the Northeast corner of this land, thence North 86 ½ W. 108 poles to a stone; thence south 4 W. 12.36 poles to a stone; thence North 87 w. 50 poles to a stone in the line of the old Huldy Randolph Payne land; thence South 4 W 35 poles to a stone; thence South 86 ½ E. 158 poles to a stone in the Cross Plains Road; thence North 4 E. 45.8 poles to the beginning, containing 42 acres, more or less, by Planimeter calculation, and being the same land which was conveyed to Lena M. Strain by E.G. Gilbert, the Register of Robertson County, Tennessee, in Deed book No.80 at Page No.587, said deed of conveyance having been executed to carry out the wishes of Thos. D. Barry, and according to a family settlement by his heirs, one of whom was said Lena M. Strain, all said heirs being then sui juris and twenty-one years of age.
To Have and to Hold the premises aforesaid, together with all appurtenances and immunities thereto pertaining, unto the said grantee, heirs and assigns, forever. The grantors covenant with the grantee, heirs and assigns: (1) That they are lawfully seised in fee simple title of said land; (2) That they have a good and perfect right to make this conveyance; (3) That said land is not incumbered; (4) That they will warrant and defend the title in and to said land against all lawful claims and demands whatsoever.
Possession of the premises will be given to the grantee on January 1, 1959, with privilege of customary Fall plowing and sowing in 1958. Crops on the premises harvestable in 1958 are reserved, and not sold herein. By special arrangement, the grantee, Rippy, will pay 1958 taxes on the premises.
