Searcy Estice & wife to John Payne 8 May 1838.
I Searcy Estice & his wife Milly have this day, bargained and sold and do hereby transfer and convey to John Payne and his heirs forever, for the consideration of eleven dollars fifteen cents to be paid, a tract of land in the State of Tennessee Robertson County and district No. one containing by estimation eleven acres and 25 poles be the same more or less, and bounded as follow, Beginning on the east bank of the road from Duer’s Mill to Mulloy’s thence north 35 poles to a stake, thence (my note, east) 51 poles to a stake in the old field near an apple orchard, thence 35 poles south to a black oak, thence (my note, west) 51 poles to the Beginning. To have and to hold the same to the said John Payne his heirs, assigns forever, we do covenant with the said John Payne that we are lawfully seized of said land, have good rights to convey it and that the same is unencumbered, we do further covenant and bind ourselves, our heirs and representatives to warrant and forever defend the title to said land & every part thereof to the said John Payne his heirs and assigns against the lawful claims of all persons whatever, this 6th day of May 1848. Personally appeared before me Joseph Winfield clerk of the County Court for said County Searcy Estice the within named bargainer with whom I am personally acquainted who acknowledged that he executed the within deed for the purposes therein contained, and Milly Estice the feme covert having also appeared before, privately and apart from her husband the said Searcy Estice and acknowledged the execution of said deed to have done by her freely, voluntarily and understandingly without compulsion or restraint from her said husband & for the purposes therein contained, Witness my hand at office this 6th day of May 1848.
