         I Solomon Payne of the county of Robertson & State of Tennessee being of sound Mind and Memory do make and ordain this my last Will and Testament hereby Revoking all other by me at any time.
          Item 1st: It is my Will and desire after the payment of My burial Expenses and debts if there should be any that my Wife Nancy Payne shall have the use of all my Household and kitchen Furniture and the use of My Homestead Tract of Land and all such provisions of Stock of every kind as three disinterested Men shall deed necessary for her future Support and if she should fail to derive to full and comfortable support therefrom then my Executor shall pay over to her as necessity requires. Such fortious of the Interest of money & debts belonging to my Estate as shall afford her a good support.
         Item 2nd: It is my Will and desire that after the above allowances is made My Executor shall sell all the ballances of my Property.
         Item 3rd: For reasons satisfactory to myself it is my Will and desire that no account shall be taken of the advances I have made to my Children & Grand Children in money and Property in the final distribution of My Estate.
         Item 4th: It is my Will and desire that after the Death of my said Wife Nancy, My Executor shall sell all the remainder of My Property of every description and an equal division be made between all My Children & Grand Children giving to each set of Grand Children one Share of their Parents first.
         Item 5th: It is my Will and desire that My Executor shall have full power and authority to sell all Lands belonging to My Estate without any decree from any Court taking Notes & Good Security retaining a lien on the Land until paid for.
         Item 6th: I nominate and appoint My Worthy Friend, Bolivar Payne Executor of this Instrument.
On Testimony whereof I have hereunto Set My hand and Seal this 7th day of Dec. 1867.

         The foregoing last Will and Testament of Solomon Payne dec’d was presented in open Court for Probate and duly proven by William Stringer and A.F. Barry Subscribing Witnesses thereto The Court there for declares said paper writing to be the last Will and Testament of Solomon Payne dec’d and ordered it to be Recorded.
