Robertson County Court October Term 1883
Mildred Payne Dec'd. Last Will and Testament
         I Mildred Payne being of Sound mind and memory do make and publish this my last will and testament hereby revoking all other wills by me made.
         Item 1st, It is my will and desire that my son E. C. Payne for the care and attention he has given me for several years shall have at my death and I hereby give to him all the land I now own lying East of the road that leads from Wm Stringers to W W Wrights line, Said road running West of my present residence – Said line to begin in W M Jernigans and run with the road before mentioned and near some double cabins until it strikes W W Wrights line.
         Item 2nd, It is my will and desire that the said E C Payne Shall hold Said land during his natural life and at his death all of said land so bequeathed shall go to his two children Elden and Julia Payne to be equally divided between them.
         Item 3rd, It is my will and desire that the residue of my land (after the above gift) lying west of the line above indicated shall at my death be sold and the proceeds of said sale shall be equally divided between my legal heirs after all my just debts are paid.
         Item 4th, It is my will and I hereby appoint L. J. Sanders as my Executor and he is hereby authorized and empowered to sell the real estate that I have herein ordered to be sold on such terms as to time that he may deem advisable and make titles to the purchaser of the same without any order of the Court and in all things represent me as if I was present and transacted the business my self. This Sept 10, 1883.

         The foregoing last will and testament of Milly Payne dec'd was produced in open Court for probate and duly proved by Wm Stringer and T M Stringer subscribing Witnesses thereto – thereupon the Court ordered the same to be recorded.
