Robertson County Court November Term 1879
This I James Eubank do make and publish this as my last will and testament hereby revoking and making void all other wills by me at any time made.
First: I direct that my funeral expenses and all my debts be paid as soon after my death as
possible out of any money that I may die possessed of or may first come into the hands of my Executor.
Secondly: I will and bequeath to my wife Charlot Eubank so much of all my estate and things that I may die possessed of as will support her comfortable during her natural life time: After this is done.
Thirdly: I will and bequeath to my son Richard Eubank and his lawful begotten children the fourth part of evrything belonging to my estate when I die.
Fourthly: After his mothers support is taken out I will and bequeath to Elijah Eubank deceast orphan children namely Charlot Harris, Elizabeth Tod, Elizea Wright, Ellen Berry, Catherine and Franklin Eubanks the fourth part of evrything belonging to my estate when I die equal divided between the above named children after their mothers support is taken out.
Fifthly; I will and bequeath to my son James W Eubanks the fourth part of everything belonging to my estate when I die possessed of.
Sixthly: When their Mothers support is taken out I will and bequeath to my son Daniel Eubank the fourth part of evrything belonging to my estate when I die possessed of.
Lastly: I do hereby nominate and appoint my wife Charlot Eubank and James W. Eubank and Daniel Eubank my Executrix.
