Suit: John G. BRADEN against Patrick H. BRADEN, Motion
GOFF and WRIGHT attorneys for pltf. Re. judgment against defendant for $312.23 with int. thereon at 6% per annum from the 10th day of April 1822. Also twenty dollars and sixty three cents costs of which he is liable to pay as the security of said Defendant on a decree ordered in the chancery ct. of GI. Cty. at April term 1833 on the 10th day of said month on an injunction he stay collection of a Judgment rendered in GI. circuit ct. at February term 1821 in favor of Philip SCHETTER and Frederic SCHETTER against the defendant and Marion T. B. UPSHAW and Reese W. PORTER for twelve hundred and seventy five dollars and eighty two cents, the injunction bond dated 25th day of July 1832. And it appearing to the satisfaction of the ct. on injunction of record in the case that the plaintiff was the security of the defendant and liable to pay said sum of money as such. It is therefore considered by the ct. that the plaintiff receive of said the sum of Thirteen Hundred and twelve dollars and twenty three cents with interest thereon at the rate of six percent per annum from the 10th day of April 1833 till this time, which is forty eight dollars and three cents, also the sum of twenty dollars and sixty three cents the costs at law of said injunction, making in the whole the sum of $1380.96 together with costs of this motion. I, William J. BROWN, do make this my last will and hereby revoking and setting aside any will made by me at any other time.
First, I direct that my funeral expenses or any debt I may owe be paid out of any money on hand, or any money that first come into the hands of my executors, second, that my personal property I leave to be equally divided between my children or to be sold and the proceeds be equally divided between them. Thirdly, I will that my real estate be sold and the proceed be equally divided between my wife Elizabeth BROWN and my seven children, namely, Martha E. BROWN, Nancy M. GRAVES, Araminta D. YOUNG, William J. A. BROWN, Mary L. WOODARD, Deanna V. PORCH, Jesse W. BROWN, my wife Elizabeth BROWN to have a childs part in the proceeds of the land in lieu of an agreement of a marriage contract having heretofore been entered into and said marriage contract is this day set aside, is void and of no force by agreement of the parties to said marriage contract. Lastly, I hereby nominate and appoint my son Jesse W. BROWN my executor with full power to sell both personal and real estate, the real estate to be sold for one third (1/3) cash, the remainder on one and two years time with interest at the rate of six percent per annum, and shall have full power to deed and convey title to purchase of said land upon the payment of the purchase money, and said executor shall after paying all debts shall divide the remainder pay equally to each of said legatees the proceeds decided from the sale of said property, the interlineation in line 17 is included in this will.
In testimony whereof I hereunto set my signature this the first day of May 1899.

BROWN as one of the legatees, the erasure in lines 5 and 6 were made before this was signed this May 7, 1899.

This cause came on for hearing before the Honorable John C. WALKER, Special Chancellor and c. Setting by Election in the place of the Hon. W. S. FLEMING is absent upon the bill pro confessions Exhibits Report of the Clerk & Master and proof in said cause and it appearing to the ct. from said report and the proof in said cause that in August 1856 James DOUGLASS departed this life having previously made and published his last will & testament which was duly admitted to probate in the Cty. Ct. of GI Cty. and the complainant the Exr. named therein was duly qualified and filed his bill in this Honorable ct. for the settlement of the said estate. It further appears to the ct. that the original will and records thereof has been destroyed and it further appears to the ct. from the proof in said cause that Exhibit "A" filed with complainants amended and supplemental bill is a true and substantial copy of said will the same having been copied from a duly certified copy of the original will. It is therefore ordered, adjudged and decreed that said Exhibit "A" be and the same is hereby declared to be a true and substantial copy of said will and the same is hereby ordered to be established as such and the Clerk & Master of this ct. will furnish a duly certified copy of said Exhibit to the Clerk of the Cty. Ct. of GI Cty. with a copy of this decree and said Ct. is hereby ordered to record said Exhibit upon the records of said ct. as the Last Will and Testament of James DOUGLASS, decd..

Thomas J. GOFF mar. a DOUGLASS appears to be the same in LA Cty., TN 1850 cen. He is 17 years younger than John GOFF of GI Cty., TN, if census ages are correct. He appears to live in Gi. before moving to La. Cty. He would be 27 in 1816, not a minor. I believe this Thomas GOFF is a brother of John Goff of GI. Cty., TN.

1856 Will of James DOUGLAS: After my death, the negroes I loaned to my mar. children to be brought back to my farm and put with the balance of my negroes then the three mar. children, John H., Martha Ann and Elizabeth Jane shall be allowed to draw a share of Negroes. The farm on which son John H. DOUGLASS now lives bought from Micajah V. LOONEY and a small parcel bought of Dr. William CHAMBERS and adjoining the lands of Samuel H. JOHNSON, David BODENHAMER to be sold and proceeds equally divided between wife and children. Wife Susan Ann DOUGLASS to have childs part in all property. The tract of land on which I now live, about 555 A be cultivated until youngest child becomes 21; then it to be sold and divided equally between wife and children. Daniel PETTY died 6-8-1860 leaving widow Martha A. and children James Francis PETTY, Mary Elizabeth PETTY, Sarah D. PETTY (mar. W. T. SMITH)
Francis PETTY was father of Daniel and grandfather of his 3 children died 5-31-1861. His estate descended to the 3 grandchildren. Mary E. PETTY mar. William T. SMITH, 23 Dec. 1875 and died 8-9-1876 leaving no issue. Martha A. PETTY, widow of Daniel R. PETTY was the daughter of James DOUGLAS. She had been previously mar. to Marion BUCHANAN, by whom she had one daughter, Madora. Martha A. mar. 3rd to H. C. KIMBROUGH, son Erastus KIMBROUGH was born to this union. Martha A. died 4-3-1871. Madora BUCHANAN mar. H. C. KIMBROUGH. Sarah D. PETTY mar. H. L. BUCHANAN.

In an earlier case Martha A. PETTY said her husband died owning 2/9 interest in a tract of land in the 18th C.D. containing about 555 A, being the tract owned by James DOUGLASS at time of his death and on which his widow Susan resided. Intestate (Daniel PETTY) owned very little other property. Due to Civil War the slaves were freed and that caused insolvency of the estate, and the widow asked land be sold for payment of debts.

In an earlier case Martha A. PETTY said her husband died owning 2/9 interest in a tract of land in the 18th C.D. containing about 555 A, being the tract owned by James DOUGLASS at time of his death and on which his widow Susan resided. Intestate (Daniel PETTY) owned very little other property. Due to Civil War the slaves were freed and that caused insolvency of the estate, and the widow asked land be sold for payment of debts.

This John GOFF is the one who moved to GI Cty., TN and lived there through 1880. He appears to be a cousin of the John GOFF who mar. Susan Walker. He also appears to have had brothers who were in GI Cty. in earlier records. A paper writing purporting to be the last will and testament of John JOHNSON, decd., bearing the date of 16th day of December 1825 was produced in ct. for probate and being read to the ct. and contents thereof duly considered, it is the opinion of the ct. that the same is contradictory, ambiguous and uncertain as to the meaning of testator, the same is therefore not permitted to probate, but required to be retained in the clerk's office of this ct. for safe keeping and on motion of Lucinda JOHNSTON and Matthew JOHNSTON adm. on the estate of said John JOHNSTON decd. is granted to them, whereupon they executed bond and security and were qualified as the law directs.
The adms. of the estate of John JOHNSON decd. returned into ct. an inventory of said estate which was ordered to be recorded.
Ordered that an order of sale issue to the adm. of the estate of John JOHNSTON decd. commanding them to advertize and sell according to law the property mentioned in the inventory by them this day returned the negroes excepted and make return thereof as the law directs.

BB, p. 293 and 294 deed, including dwelling house and about 250A which his wife Mariah held in her own right by deed of gift from her father Richard JOHNSON, decd., and on which the David F. and Mariah were then living until spring and summer of 1865 when not occupied by the United States Army it was by Confederate troops and during said occupation and the contending enemies no profit was realized from farm, stock and much of stock lost by imprisonment and marauding parties. He sold the crop of cotton to W. G. S. ANDERSON for $568 in July 1862 and applied the money to payment of the debts of said David F. ... in 1862 which was exchanged by said Mariah for domestic and factory goods for herself and family .... David in 1867 rented parted of the farm to John R. JOHNSON .... he borrowed money from Mrs. Erixenna JOHNSON .... conveyed by deed the farm, etc. to Mariah. Vol. 10, Chanc. Ct. Min., pp. 304-311.

I, Benjamin F. KIMBROUGH, being of sound mind and disposing memory knowing my Mortality and that it is appointed to all men once to die, I therefore make and ordain this to be my last will and testament.
1st I recommend my soul to God who gave it my Body to be buried in a Christian like manner and after all burial and funeral expenses is paid out of any means or money that be on hand at my decease
2nd I give and bequeath to my beloved wife Elizabeth S. KIMBROUGH all the remaining part of my property both real and personal to dispose of at her will and pleasure either by will deed or otherwise as may please her to do and further appoint my believed wife E. S. KIMBROUGH my sole executrix of this my last will and testament and advise that as soon as convenient after my decease that this will be put in force and desire the ct. to ask nor exact any bond of her my reason for giving all my estate to my wife is that I received it by her from her fathers estate and consider it lawfully her right. Given under my hand and seal day and date above written.

Wagons & harness, farming implements of all kinds, provender, provisions, household & kitchen furniture, moneys, notes, claims, choses in action, accounts, etc. that may not here be named or described that is now owned & belongs to or that may hereafter come into her possession of or be purchases with the money, notes, claims, accounts or property to the said Ella SAUNDERS now as I. Z. PAR-KER, Jun. deem proper & prudent to settle all the above named & described property upon the said Ella SAUNDERS for & in consideration of the aforementioned marriage, have & do release all right, title & interest that I might otherwise acquire to the above mentioned property by virtue of said marriage the said property is to belong to said Ella SAUNDERS as if said mar-riage had never taken place. She is to hold the same to her own sole use & benefit free from my contracts, liabilities, contract or influence. I have integrated the geneanlogical information in the above reference with my own research. A sister of my great-grandmother is the Sarah Jane MARTIN who mar. Mastin USSERY. A descendant of Mastin Ussery asked for my help on this family. She was not a researcher technically, yet she wanted to do a book on the Ussery Lineage. I do not know if she finished her project, not haveing heard any more from her for several years.

Bolivar is on Ms. River and has two Cty. Ct.houses. Both would have to be checked, Chancery Ct. has land records, which should include slaves bought and sold, as they were considered chattel. Written above his name was "Agent for Mastin". I suppose this means Mastin was the owner of the property, which could be land, slaves or both. I suspect working the deeds there should reveal the kind of property and should be in Mastin's name. Now I wonder if the reason "the gold was buried in his yard" was from slaves that two brothers were "running" was not in fact the property of Mastin and the reason the gold was buried in his yard. "A fellow named Sam BROWN who waned to marrie Gussie, Daughter of M. USSERY and who was unfavorably looked on by the old man, on the 7th went to his sweethearts house and in cold blood shot and killed her father." Published in "TIPS OF TEXAS" genealogical quarterly of Harlingen, TX, Vol. 3, No. 3, Nov. 1965, p. 25.
A descendant said the story was Sam BROWN asked for the hand of Gussie and was refused because she was too young, He came back to the USSERY home a 2nd time and again refused, whereupon he shot & killed Mastin on his front porch. They buried Mastin in the front yard of the home, which became the USSERY Cemetery. The graves of Mastin and Sarah Jane are the above-ground type about 2-3 feet high and filled in with asphalt when I saw it. Several USSERY family members are buried there.
This descendant also said sons and sons-in-laws formed a posse and caught the Sam Brown. They hanged him in the town of Luling and then dragged his body behind a horse through the town. Charges were brought against the posse memebers. Some of them went to California until the charges were dropped. The descendant said it was the last hanging in the Cty.

State of TX, Caldwell Cty.: Be it remembered that on the 2nd dau of August 1886 there was begun and holden a regular term of the Cty. Ct. for said Cty. for civil criminal and probate business office. Presesent Hon. Leo ROGAN Cty. Judge presiding, A. F. FIELD, sheriff and W.C. CARPENTER, clerk when he following probate business was transacted to wit.
In matter of the application of Mrs. S. J. USSERY, asing to be appointed administratrix of the estate of her decd. husband Maston USSERY come the said Mrs. S. J. USSERY by her atty. and presented to the ct. said application for its consideration, and said application being duly considered by the ct. and it appearing to the satisfaction of the ct. that legal notice of the filing of said application had been given and that there was no objection urged against said appointment it is therefore ordered and adjudged by he Cty. that the said Mrs. S. J. USSERY be and she is hereby appointed administratrix of said estate and that letters of adm. issue to her upon her filing in this count a bond with good security in the sum of $1400 to be approved by this ct. and taking the oath of office as required by law. It is further ordered by the ct. that A. J. CONNOLLY, D. M. DAY & W. P. DUNLAP be and they arae hereby appointed appraisers of said estate to appraise the property of said estate.
