THIS INDENTURE made the 28th day of March 1878, between UNION CONSOLIDATED MINING COMPANY OF TENNESSEE , party of the first part, by E. G. DUVALL its Superintendent and Josiah BROOKS of Polk County, Tennessee, party of the second part.
WITNESSETH:
That the party of the first part, in consideration of the sum of one dollar
[$1.00] to it paid by the party of the second part and other considerations,
does hereby convey to the party of the second part with the reseration and
exception hereinafter mentioned), a certain town lot of land situated at
Ducktown, Polk County, Tennessee, and known an designated on J.D. HOWELL's map
of the so styled new town of Ducktown as number fifty [50] in block two [2].
Said entire lot fronting on Cove Street, 50 feet and extending to Canal (or "Connal)
Street 170 feet be the said measurements more or less; EXCEPTING and
reservingk however, from this conveyance and not hereby conveyed a portion of
the Northerly part of said lot extending across the lot to the side lines
thereof and including a log dwelling house standing on such Northerly portion
of said lot of land. Such reserved portion measuring and being fifty [50] feet
along said side lines of said lot and bounded by said side lines to the extent
of 40 feet (to be located and measured so as to include the said log dwelling
house with its appurtenances and straight lines to be drawn across said side
lines of the lot from the ends of said 50 feet lines to measureds making a
square or parallelogram of about fifty [50] feet on each of its several sides.
AND, the party of the first part hereby warrants the title to so much of
said lot number 50 as is hereby conveyed as aforesaid against all persons
claiming under it.

Looks like L. McGEE was the notary.
Josiah Brooks was also legally known as Joseph or Josephus BROOKES. He also
had son named Joseph/Josiah Brooks who also resided in Polk Co., TN. Not sure
which one this deed is referring to at this point in time. I assume the father
received this lot in consideration of his length of service as an employee of
the company and whose other son, Adolphus BROOKS was asked to be the mining
company's doctor. Reason: consideration for this deed was only $1.00, which
even for it's day was a small sum, and is usually used in deeds where love and
affection is the main consideration. This deed is with a company so there no
love and affection that can legally be had, so the other consideration
mentioned must have been for length of service or something similar.
This BROOKS family was from Cherokee Co., NC and you will find other deeds

for and in consideration of the sume of $300.00, in hand paid by the said party
of the first part; and the said party of the first part, by these presents, do
hereby grant, bargain, sell, tranfer and convey unto the said party of the
second part, his heirs and assigns, the following described parcel or tract of
land, to-wit: Situated, lying and being in the Eighth [8th] Civil District of
Polk County, Tennessee, and in the town of Hiawassee in said County and State,
the same known and described in the plan of said town as Lot Number ten [10],
back of lot number nine [9], which fronts on Main Street in said town, County
and State, and bounded on the North by James NAUKIVELL, on the East by Tennessee
Copper Company, on the South by H.P. KIMSEY, and on the West by ABERNATHY &
CENTER, the fence being the line lying and being in the Eighth [8th] Civil
District of Polk County, Tennessee and known as ABERNATHY lot. TO HAVE AND TO
HOLD to him, the said Oscar and Arthur ROBERTS, party of the second part, his
heirs and assigns forever, with appurtenances and all the right, title and
interest of the said party of the first part thereunto belonging. AND, I, E.L.
ROBERTS and wife, party of the first part, covenant that I am lawfully seized
and possessed of the above-described land, and that I have a lawful right to
convey the same in fee simple, that the same is unencumbered; and that I further
covenant that I will forever warrant and defend the title against the claim of
all persons whomsoever. IN TESTIMONY WHEREOF, I have hereunto subscribed my
name on this the 1st day of March, 1902.

E.L. ROBERTS a/k/a Elijah L. ROBERTS [1850-1933] and wife: Sarah Jane
BROOKS-ROBERTS [d/o of Josephus "Josiah" BROOKS and Susan ??] were the
parents of Oscar and Arthur ROBERTS. They married 2 sisters, Mary and Medley
BOWERS, respectively, in 1910 in Polk Co. They were dtrs of Elias B. BOWERS and
Ruth AKINS-BOWERS [d.1910] of Blue Ridge, Fannin Co., GA. Elijah & Sarah
ROBERTS are buried in Ducktown Cem., Polk Co., TN Oscar is buried in Atlanta,
GA. Arthur died in 1977..still trying to locate his grave.

This Indenture, made and entered into this twenty-fourth day of June, 1856,
between C. M. STILES and J.B. Stiles of the County of Cherokee and the State of
North Carolina of the one part and Leathy ROBERTS and her two children, to-wit:
Elijah ROBERTS and Anne Maranda [ROBERTS] of the same state and county of the
other part.
W I T N E S S E T H:
That for an in consideration of the sume of Three Hundred Dollars [$300] to
us in hand paid by John STANDRIDGE, the receipt of whereof is hereby
acknowledged, have bargaind and sold and by these presents do bargain and sell
to the said Leathy ROBERTS and her two children, Elijah and Ann Maranda, a
certain piece or parcel of land lying and being in the county of Cherokee and
State of North Carolina and known as Lot No. 90 original survey and including in
the Stiles donation and bounded as follows, to-wit:
Beginning on a black oak on the top of a mountain and runs south one hundred and sixty [160] poles to a post oak in a field, then West one hundred and sixty [160] poles to a dogwood on a branch, the North one hundred and sixty [160] poles to a black oak, then East one hundred and eighty-eight [188] poles to the beginning. Containing one hundred and eighty-eight [188] acres.
TO HAVE and TO HOLD to the said Leaathy ROBERTS and her two children forever, and we, the said C. M. STILES and J. B. STILES, will warrant and forever defend the title of the aforesaid lot of donation from the lawful claim of ourselvezs and heirs and assign forever, and fromthe lawful claims of any and all other persons whatsoever to the said Leathy ROBERTS and her two children, Elijah and Ann Maranda, to their own proper use and behoof.
In Testamony whereof, we have herewith set our hands and seals this 24th day of June, 1856.

Leathy ROBERTS was living in Ducktown as of 1870 Census and she apparently died after the 1880 Polk Co., TN Census. Her son, Elijah lived all of his adult life in Ducktown working in the Burra Burra mines and changing house.
