Benton Town Lots Sold - 1840

©PCHGS QUARTERLY & Newsletter MAY 2001

In the Polk County, TN County Court Minutes, the reports and proceedings of the commissioners read as follows. (TSLA Microfilm Roll #25.)

"Be it remembered that on the 12th day of December in the year of our Lord 1839, pursuant to an act of the general assembly of the state of Tennessee passed at Nashville on the 28th of November in the year aforesaid. Establishing the County of Polk and in conformity with the requisition of said act, James Hayes, John Williams, Allen Armstrong, A.R. Stephenson and John F. Hannah met in the town of Columbus and took oaths as Commissioners of the County of Polk for the town of Benton and on a motion of James Hoyles, A. R. Stephenson was appointed Chairman of the Board until the next meeting and John F. Hannah was appointed Clerk. The Board then issued an order to James McCamy to run and mark the county line, also issued notices to James Hawkins, Erby Boyd, John Towns and Thomas Harper, the names of the absent commissioners as named in said act and to meet at Michael Hilderbrand's on Thursday next and adjourned to meet with the absentees on that day and at the above named place."

After several meetings to discuss a suitable location for the new county seat, "there was found to be a majority of one hundred and three given in favor of the cite at McKamys." Thomas McClary and James McKamey were appointed to "lay off into lots streets and alleys the portion of land procured for the Town of Benton" and appointed John Williams to go to Athens and have the sale of lots advertised and blank deeds printed. The total cost for this advertising amounted to $23.50; $7.50 going to Frazier and Williams for advertising, $8 for printing 100 hand bills and another $8 for printing 160 blank deeds 'on fine paper.'

Unfortunately, the plans drawn up by McClary and McKamey did not meet with the approval of the Commissioners and they asked to be excused from the jobs since they 'had other business that was calling them to attend to.' John F. Hannah was appointed to try his hand at the job and was apparently successful for the sale of lots began on Tuesday, April 7th and concluded on Friday, April 11th, 1840.

Those purchasing lots, or at least giving their notes to the commissioners that they would pay are as follows: (Much of the $11, 590 was never collected.)
