Remarks: Among prominent persons buried are Col. William M. Biggs, the county's
first Circuit Court Clerk and member of the State Legislature. He has a
descendent, Burch Biggs, who has been sheriff of the county for three terms, and
a son Broughton Biggs, who is the present Sheriff; Col. David Stewart and wife,
Ann, who were parents of James B. Stewart, Mayor of Cleveland; Hugh Knox and
wife; John W. Hildebrand 1818-1909, a son of John w. Hildebrand Sr. who built
the first mill in the county for the Indians in accordance with Dearborn's
Treaty with the Cherokees, Jan. 7, 1806 to be built within one year. He , JohnW.
Jr. was a Cherokee Councilman at the time the Indians were sent to the Indian
Territory. Lawrence Hilderbrand, son of John w. Hildebrand, Jr. was register of
Deeds for Polk County; Jack Hildebrand, brother of Lawrence Hildebrand; Dr.
Robert N. Fleming, Reg. of Deeds for 17 years and physician for over 50 years;
Virgil A. Clemmer, co-editor of the Benton paper, later editor of the Cleveland
Banner and Knoxville News-Sentinel. Several Negroes buried in westwise, and
Hildebrand slaves in south corner. Negroes now use King's Cemetery. Condition:

The old Town cemetery here in Benton has for the last few years been almost abandoned for recent interment purposes. Only a few families yet living in this section use any part of the old cemetery. Two additions have been made to it - the last one a well-fenced acre for private lots, each fronting upon an aisle. So few families remain her who use the old cemetery that the duties of fencing the grounds and caring for them fall heavily on these families. A few years ago B. F. McClary took the lead in fencing and cleaning it off and had to bear the greater part of the expense. Last year W. M. Clemmer had it cleaned off and sowed in blue grass at his own expense almost entirely. Now the fence around it is about half down, and these two men and Rev. Robinson, Walter M. Harrison and others have started a movement to put a good fence around it and have the grounds well taken care of and beautified.
Scores of people living in Cleveland, Charleston, Chattanooga, and other nearby places as well as hundreds in the west have ancestors interred in this old cemetery. As the cemetery as a public interment ground is about filled and fast becoming an abandoned place, its early history and something of its sacred ashes of long silent tongues of early pioneers and public benefactors almost forgotten by the younger generation will no doubt prove interesting to posterity. Some families have five generations represented in its hallowed precincts.
Fragments of its history and something of its occupants is recalled or found from records written in courthouse tomes or marble tablets. How appropriate is a cemetery for the soul's meditation on a sunny Sabbath afternoon. The souls of the saved are in the land of the living - it is we who walk and talk on earth that are in the land of the dying.
In 1840 James McKamy owned the land where Benton now stands; and in the sale of town lots by the town commissioners, the record of the last lot offered for sale reads, "Lot No. 8 swapt to James McKamy for a graveyard." In other words, McKamy was to give a graveyard lot further out of town. Lot No. 8 is the lot in the north corner of Benton, and was later given to Ocoee Academy. McKamy offered the town people the choice of two places for a cemetery, one being the hill where the high school building is being erected and the ground just northeast of it, and the other the site of the present cemetery. The people of the town voted upon the two sites, choosing the latter.
In places, the box vine and other growth makes such a heavy carpet that the unmarked graves cannot be distinguished, but a careful count and estimate places the number interred in the town cemetery at six hundred. Of this number about 400 are either marked by rough stones without names upon them, or have no markers at all. Possibly half of those without names given are known by somebody or other, but unless they are marked or numbered soon with a record of the name, the entire four hundred or more will be "unknown dead" as are now from 100 to 300 of them.. Among the unknown are some prominent in the early history of the county.
The town is sadly in need of a successor to Gilbert Blankenship, the caretaker of the cemetery until his death about twenty years ago. He knew whose graves practically all the unmarked ones were, but his knowledge of them died with him. And since his day no one has appeared to take his place.
