January term

p.84

On motion of JOHN H. BRIENT and others . To incorporate the town of Montgomery is therefore ordered adjudged and decreed that eh dame shall be incorporated and that the incorporate limits shall be as follows: Beginning at the sign post on the south side of EMORY RIVER, running down the river so as to include RICHARD O. TAYLOR to a stake on the opposite side of the river below J. H. BRIENTS stable then across the river running to a stake above M. M. BROWNS so as to include LEWIS NITZSCHE then running so as to include the graveyard to a stake beyond the graveyard, thence back to the beginning.

P. 86 A partition was presented to the court by AN___ M. HARGRAVE Att. for JAMES R. ALLAHER, MARY H. HARGRAVE, and JOHN A. GALLAHER, to sell all of the land of JAMES A. GALLLAHER dec’d it is ordered that the land be sold.

Ordered by the court that J. D. WELCH, JOHN H BRIENT and J. F. SCOTT be appointed to lay off and set appart (sic) for MARY HUMAN, widow of H. HUMAN dec’d one years support out of the effect of her husbands, the said H. HUMAN dec’d, and make a report to the next term of court.

A. J. HALL a citizen of Morgan County is dead, he died instate and on motion, it is ordered by the court that JAMES B. JONES, WILLSON (sic) SUMMERS and AMOS TAYLOR be appointed commissioners to lay off one years support for MARY ANN HALL out of the estate of her husband the A. J. HALL, and make report to the next term of court. W. H. BREEDLOVE applied for letter of administration for the estate.

Satisfactory evidence is presented that SHADRACK STEPHENS, a citizen of Morgan County is dead, he died instate and upon application MESHACK STEPENS and SUSANNAH STEPHENS are appointed adm. of the estate.

P. 106

J. F. SCOTT, JOHN H. BRIENT and C. H. SAFFILL?? Is appointed by the court to lay off a years support for SUSANNAH STEPHENS out of the estate of her husband SHADRACK STEPHEN and make a report to the next term of court.

JOANTHAN McPETERS returned to the court an inventory of the property of the estate of FIELDING GRIFFITH ded’d , which was reviewed and ordered spread upon the inventory book.



June term

p. 107

satisfactory evidence of the death of ALPONSE HENNI GENEA DE MONTAQULE late a resident of the state of TENNESSEE. He died instate and at the time of his death he was seized of goods , chattel, lands and tenements and on application, it is ordered by the court that A. W. GERDING be appointed adm. of the estate.

MESHACK STEPHENS adm. Returned an inventory and account of sales of the property of SHADRACK STEPHENS dec’d all of which was ordered to be spread upon the inventory book.

Satisfactory evidence is given to the court of the death of LARKIN JONES, late of Morgan County, he died instate and he was seized of goods, chattel and rights. SAMUEL JONES made application and was approved as adm. of the estate.

G. W. KIETH Deputy Clerk exhibited to the court a settlement he made with R. A. DAVIS and A. J. SUMMERS adm. of the estate of LEMUEL SUMMERS which was approved and admitted to record.

The court appointed A. J. DAVIS as guardian of NANCY, JAMES ANDERSON and SALLY SUMMERS, minor heirs of LEMUEL SUMMERS dec’d.



October term

p. 124

It is proven to the satisfaction of the court that JOSHIA (sic) KENDRED late of Morgan County a U. S. pensioner is dead. He died 9-19-1857. He was at the time of his death in the receipt of a pension at the rate of $72 per annum for service as a private in the 4th Regiment U. S. Infantry. At the time of his death a remnant of pension was due him, he left a wife living, who now resides where her husband the said JOSHIA KENDRED dec’d, died in said county.



December term

SAMUEL DAVIDSON is dead, he died in Morgan County, leaving no will or testament, WILLIAM BEARDEN is appointed adm. of the said estate.

It is proven to the court that MELINDA DELDINE is of unsound mind and is unable to conduct her own affairs and HARMON DILDINE was appointed her guardian.

P.131

JOHN H. KINGTON, Judge of the County Court bound IRVIN BENEKE, an orphan of the age of 7 years to DEDERICK KRISS until age 21. He is to learn the trade of house carpenter.

P. 132

ANNA AMSELEA BENEKE, an orphan the age of three is bound to ELIZABETH KRISS until age 18, she is to be taught weaving, sewing, housewifery and to read and write.

It is proven to the satisfaction of the court that FREDERICK BENEKE late of Morgan County is dead, he died instate and upon application JOHN WHITE id appointed adm. of the said estate.
