Last Will and Testament of Samuel Edmondson

I, Samuel Edmondson, do make and publish this as my last Will and testament hereby revoking and making void all other wills by me at any time made.

First, I direct that my burial expenses and all my debts be paid as soon after my death as possible out of any money I may die possessed of or(?) may first come into the hands of my executor.

Secondly, I give and bequeath unto my wife, Nancy Edmondson, the tract of lands I now live on and own or may own at the time of my death.  I also give her ten first-choice of my negros.  I also give her all of my household and kitchen furniture as she may want for her own use and as much stock of every kind as she may desire consisting of horses, cattle, hogs and sheep and as many forming tools as is nessary to carry on the farm together with as much of the crops that may be on hand at the time of my death as she mayh want for her own used and family and so much money as she may think nessary for her use for the space of one year.

Thirdly, I give and bequeath to my daughter Nancy Jane Edmondson one negro girl about grown worth five hundred dollars and a negro boy or(?) girl small valued at three hundred dollars about six or(?) eight years old and our piano worth about three hundred dollars.  I also give her seventy five dollars in money to purchase her table furniture, loom & horse, one cow & calf, one sow & pigs, eight head of sheep which I consider makes her equal with my children that have been advanced heretofore.

Thirdly (?), I give and bequeath to my daughter-in-law Minerva E. Edmondson and her two children Bennetta and B. R. Edmondson the one half of a share of my estate to be equally with her and her two children, Bennetta and B. R. Edmondson, the children of Benjamin Edmondson, dec'd.

Fourthly, I give and bequeath to my daughter Martha E. Mathis the wife of James A. Mathis one equal share of my estate her(?) for her sole use separate and free from the debts or contracts of her husband James A. Mathis aside for her own use and benefit during her lifetime and then to be equally divided among all of her living heirs share and share alike.

Fifthly, I give and bequeath to my son Robert Edmondson one equal share of my estate.

Sixthly, I give and bequeath to my son William Edmondson on equal share of my estate.

Seventhly, I give and bequeath to my son John Edmondson one equal share of my estate.

Eighthly, I give and bequeath to my daughter Mary C. Kessee the wife of John A. Kessee on equal share of my estate during her natural life but if she is with out boddes by issue (? Does this mean childless?) the share I bequeath to her is to return back to my estate and be equally divided among my heirs.

Ninthly, I give and bequeath to my son Upton Edmondson one equal share of my estate.

Tenthly, I give and bequeath to my daughter Nancy Jane Edmondson one equal share of my estate but if she die with out boddes by issue(?) said bequeath to return back to my estate and to be equally divided among my heirs.

Eleventhly, I desire at the death of my wife Nancy Edmondson that lands bequeath to her be sold for a duestion(? No idea, maybe division?) by my executor after giving sufficient notice on such terms so as to settle off with my heirs by paying over the notes to each leggatee and, as there are some minors, I make it my will that the right of the lawful guardian shall be as good a voucher in the hands of my executor as a leggatee that is of lawful age and I also fully authorize and empower my executor to sell with out an order from Court and to make title to the lands sold by him.  I also direct that my executor sell all of the pirrisable property of every description that is not otherwise disposed of at my death or the death of my wife Nancy Edmondson.  I also direct y Executor to get an order from court for a divition(division?) of my negro property.  I direct my executor in all cases of sales of lands or property of any kind to take his note and arrange his sales so that he may pay off the leggatees in note in all cases.

Lastly, I do hereby nominate and appoint William Edmondson my executor and authorize and request the court to grant him letters of administration without security.  In witness whereof I do to this my will set by and seal this 4th day of February 1859.
