The Last Will and Testament of R.F.M. Kirkpatrick of South Pittsburg, Tennessee.

I, R.F.M. Kirkpatrick, of South Pittsburg, Tennessee do hereby make, publish and declare the following as and for my last will and testament,

1.

I hereby revoke all former and other wills and testamentary dispositions heretofore made by me.

2.

I direct that all my just debts and funeral expenses be paid as soon after my death as can conveniently be done.

3.

I give and bequeath to my wife, Blanche W. Kirkpatrick, for and during her natural life, unless she should sooner marry, the use and income from all my property of every kind wherever situated, remaining after the payment of my debts, and, at her death, I direct that the same be divided equally between my children, Joe W. Kirkpatrick and Marion M. Kirkpatrick Anderson, to whom I give the same share and share a like.

4.

If my wife, Blanche W. Kirkpatrick, should marry then her right to the use and income from all my property conferred in paragraph three hereof shall cease and determine [sic] and, upon the happening of that event, my children Joe W. Kirkpatrick and Marion M. Kirkpatrick Anderson, shall then have and receive each an one-third of all my property absolutely and my wife, Blanche W. Kirkpatrick, for the balance of her natural life, shall have, free from the debts, marital rights and control of her husband the use and income from the remaining one-third of my property and which, at her death, shall be divided equally among my children Joe W. Kirkpatrick and Marion M. Kirkpatrick Anderson, to whom I give the same share and share alike.

5.

I hereby nominate and appoint my wife, Blanche W. Kirkpatrick, executor of this my last will and testament and excuse her from giving bond as such.
6.

In witness wherof [sic], I have hereunto subscribed my name in South Pittsburg, Tennessee, this the 1st day of February, 1921, in the presence of Alan S. Kelly and H. M. Towles, whom I have requested to become subscribing witnesses hereto.

The foregoing instrument was subscribed, published and declared by R.F.M. Kirkpatrick as and for his last will and testament, in our presence and in the presence of each of us, and we, at his request, at the same time and in his presence and in the presence of each other, hereunto subscribe our names as subscribing witnesses, this the 1st day of February, 1921.

Codicil of Will of R.F.M. Kirkpatrick

I, R.F.M. Kirkpatrick, do hereby make, publish and declare the following as and for a codicil to my last will and testament, the same having been made and executed by me on February 1st, 1921, the same to have the same effect and construction as if originally incorporated in and made a part of said last will and testament.

I hereby authorizes and empower my executive [sic] named in my last will and testament, Mrs. Blanche W. Kirkpatrick, to sell and dispose of all or any of the real estate or personal property of which I shall die seized and possessed, at public or private sale, at such times and on such terms and conditions as she shall deem meet or proper, and to execute, acknowledge and deliver all proper writings, deeds of conveyance and transfers therefor [sic].

In witness wherof [sic] I have hereunto subscribed my name in South Pittsburg, Tennessee, this the 28th day of February, 1921, in the presence of H. M. Towles and Alan S. Kelly, whom I have requested to become attesting witnesses hereto.
