Last Will and Testament.

I, Catherine Smith, of Marion County, Tennessee, do made [sic] and publish this my last Will and Testament; hereby revoking all other Wills by me at any time made.

FIRST,- I direct that all my just debts be paid out of my estate, by my executor.

SECOND,- I give, devise, will and bequeath, unto my sister Mary Smith and my two brothers, L. D. and Burrell Smith, all the property of every kind, personal, Real and mixed, of which I may die seized and possessed, in equal parts, unto each a one third interest therein.

THIRD,- In case my sister Mary, or either of my brothers, L. D. or Burrell Smith should die before I do, then in that event, it is my desire, and I so direct, that all my property of every kind, of which I may die seized and possessed, be divided equally between the other two that may be living at my death: or if any two of the above mentioned sister and brothers should die before I do, then I will and direct that all my property of every kind, of which I may die seized or possessed, shall go wholy [sic] and absoutely to the one surviving.

FOURTH,- I hereby appoint Burrell Smith Executor of this my last Will and Testament.
