Will of L. D. Smith

I, L. D. Smith, of Marion County, Tennessee, do make and publish this my last will and testament: hereby revoking all other will by me any time made.

1st. I direct that all my just debts be paid out of my estate, by my executor.

2nd. I give, devise, will and bequeath, unto my two sisters, Mary Smith and Catherine Smith and my brother Burrell Smith, all the property of every kind, personal. real and mixed, of which I may die seized and possessed, in equal parts, unto each a one third interest therein.

3rd. In case either of my sisters Mary or Catherine or my brother Burrell Smith should die before I do, then in that event, it is my desire and I so direct, that all my property of every kind, of which I may die siezed [sic] and possessed be divided equally between the other two that may be living at my death; or if any two of the above mentioned sisters and brothers should die before I do, there I will and direct that all my property of every kind, of which I may die seized and possessed shall go wholy and absoutly [sic] to the one surviving.

4th I hereby appoint Burrell Smith Executor of this my last will and testament.
