I, Emma E. Payne, in the county of Grundy and state of Tennesssee, being of sound mind and memory do make and publish and declare this to be my first and last will and testament, this the ninth day of November, one thousand nine hundred and seventeen.

As to my worldly possessions, both real and personal of which I shall die seized and possessed or to which I shall be entitled at the time of my death, I advise bequeath and dispose thereof in the manner to wit as follows:

I give devise and bequeath to my beloved son, Charles Buford Payne, twenty five percent of my earthly possessions and to his wife Eva Eddins Payne, twenty five percent and thereof, and to by beloved daughter, Katie P. Sayles fifty per cent thereof. My earthly possessions consisting mainly of the following at my decease:

All cash on hand and in bank or banks

$600.00 (six hundred dollars) which was left me by my husband, which I have loaned out on interest in the confidence and personal care of Mr. A. A. Cook. of South Pittsburg, Tenn. until settled.

Insurance on my own life $1000.00

With minor exceptions as follows to wit:

To my grandson, Charles Buford Payne, Jr., I leave my set of solid silver spoons.

To my grand-daughter Mary Orme Sayles, I leave all my linen and dishes, locket and wedding ring.

To my grand-daughter Grace Leota Payne I leave my opal ring which was presented to me by my son Buford.

to my daughter-in-law Eva Eddins Payne I leave my rustic what-not stand and my revolver.

To my daughter Katie Payne Sayles I leave my two feather beds and all furniture of what so ever nature I may be possessed with in my home at the Toll Gate, or in her home at Monteagle. This does not include any thing which may be in possession of my son Buford in his home at Monteagle.

It is my will that my funeral expenses be paid in full by my executor herein after named before the aforesaid division of my earthly possessions shall be made.

I futher [sic] will that in case my son should precede me in death that his inheritance as above stipulated shall go to his wife Eva E. Payne in order that she may use same for the benifit [sic] of her children.

Likewise I will that in case my daughter-in-law Eva Eddins Payne should precede me in death that her inheritance as above stipulated shall go to her husband, my beloved son Charles Buford Payne.

I do nominate and appoint Mr. A. A. Cook of South Pittsburg, Tenn, to be the executor of this my first and last will and testament, requesting that he execute same as quickly as possible for the benefit of all parties concerned therein.

In witness whereof I, the said Emma E. Payne, have to this my first and last will and testament, consisting of two sheets of paper, subscribe my name this the ninth day of November, in the year of our Lord, ninteen hundred and seventeen.
