I John J. Ingle, of South Pittsburg, Marion County, Tennessee, do hereby make and publish this as my last will and testament hereby revoking any former will by me at any time made.

First: I direct that all my just debts, including funeral expenses, and expense of administration upon my estate, be paid by my hereinafter named executor out of the personal property or estate that I may die seized and possessed of before encroaching upon any of my real estate.

Second: I hereby devise, will and bequeath unto my beloved wife, Rose E. Ingle, the proceeds of all my life insurance, and in addition thereto I devise, and will, and bequeath unto her the following real estate, viz: the home or dwelling place consisting of house and four lots situtated on [blank space] Avenue in the city of South Pittsburg, Tennessee, and being the same place and at which I now reside, together with all the furniture and contents of said house and home. She to have all of the above real estate and personal property and life insurance to her sole and separate use, and with full right to sell and dispose of as she may chose.

Third: the remainder of all the property I may die seized and possessed of, including all personal property of every kind and description, cash on hand, or in bank, open accounts, notes, stocks, bonds, choses in action, and any and all real estate, except as set out in paragraph two above, owned by me at the time of my death, no matter where the same may be located, I give and bequeath and will and devise to my four children, John J. Ingle Jr., Avyline Rose Ingle, Mary Cathrine McDaniel, Fanny Neil Ingle in equal one-fourth parts, or share and share alike, except as to the share to my daughter Fanny Neil Ingle and to her I give and, devise and bequeath in addition to her one fourth part the sum of ($750.00) Seven hundred and fifty dollars, which shall be taken out of my said estate as mentioned in this paragraph before the provate [sic- probate] among my said children, I do this because I have already provided to a certain extent for my other children, and for the further reason that said child, Fanny Neil Ingle, is yet young and this sum is desired to be given her to aid her in obtaining her full and complete education.

The real estate herein devised and willed to my aforesaid children consists of that known as my present two story brick drug store building and the post office building on Cedar Avenue, between 3rd and 4th Streets, South Pittsburg, Tennessee, one two story brick building, known as the R. M. Payne building, on Cedar Avenue, between 3rd and 4th Streets, South Pittsburg, Tennessee, and being the same purchased by me from S. A. Dunwoody and E. E. Hickman, also a one half undivided interest in the property of about six and one half acres purchased by me and J. C. Scott from Maj. E. B. Stahlman, the same lying across the right of way of the Memphis--Chattanooga Railway from the property of the Lodge Mfg. Company in South Pittsburg, Tennessee, and also a one half undivided interest in 140 acres of land lying in Pennington County, Minnesota, being the same property owned by me and C. L. Hackworth, also one lot in what is known as Kirkpatricks addition to South Pittsburg, Tennessee, also one lot in the city of South Pittsburg, pruchased [sic] by me from Mrs. Joe Barnes, and any other real estate no matter where the same may be located that I may die seized and possessed of.

Fourth: I herein name, constitute and appoint Avyline Ingle as my executor under this will. Said executor to give the proper bond for the faithful discharge of all duties hereunder, but I desire that the cost incident to making such bond be paid out of proceeds of my estate, and this item be treated as one of the debts owing by me and charged to my estate. Said executor to have full power to sell and dispose of all my personal property and real estate, and in disposing of my real estate, I desire that that in which I am jointly interested with other persons be the first disposed of as soon as the same can be done advantageously and at a fair price and I request that in disposing of the other real estate that full advantage be taken of the proper time at which to sell the same at the best price and terms, so that it will realize its full value. My said executor is hereby fully authorized to take possession of any and all of my personal property and choses in action and real estate wherever same is found and to dispose of same either for cash or on time, as may be best and divide the net proceeds of the same in accordance with my above requests.
