Will of John R. Holoway

Lillie, Bob and Joe has boarded me all the time since the date of my will and I give them the amount of their rent for my board and I think this will verry [sic] near equal my little estate so all of you children take what I give and be content I don’t think I am partial.

I J. R. Holoway, of sound mind and disposing memory do make and publish this as my last will and Testament.

First Clause.


I give and bequeath my daughter, Lillie B. Holoway, of Marion County, Tenn. The following described tract of land situated in the third Civil District of Marion County, Tenn and described as follows;

Beginning at the S.W. corner of my homes place and running thence Eastwardly with the original line, 66 Poles and 26 links to a gum tree. Thence N.2 1/2 E. 47 poles a rock, thence Northwardly 40 poles to a rock in the Hilliard Spring branch, it being the line of the Joe Holoway tract of land bequeathed him by me. Thence with said line and Branch 50 poles to a rock in the Looney line where the said branch crosses it, Thence, with said Looneys line S 2 ½ W 46 poles and 7 links to the beginning, containing 25 acres more or less.

Second Clause.


I give and bequeath to my son G. F. Holoway, of Marion County, Tenn. The following described tract of land situated in the third civil Dist of Marion County, Tenn. And bounded as follows. Beginning on a rock in the J. R. Holoway and D. R. Deakins line running, Thence N. 1 ½ E. 162 poles to the mouth of the P. G. Pryor Spring Branch. Thence down the Hilliard Spring Branch 73 poles to a rock in the center of said branch Thence Southwardly 40 poles to a rock, it being the N.E. corner of the Lillie B. tract bequeathed her by me. Thence with her line Southwardly, 47 poles, Thence S. E. ½ W. 52 poles to a rock. Thence with D.R. Deakins line 39 ½ poles to the beginning, containing 35 acres more or less.

Third Clause


I will and bequeath to my son Joe E. Holoway of Marion County, Tenn the following described tract of land situated and being in the third Dist of Marion County Tenn. Bounded as follows.
Beginning at a stake in the Hilliard Spring Branch where it crosses the line Looneys and my home tract. running [sic?] thence N. 55 E, 123 poles to mouth of P.G. Pryor Spring Branch. Thence with the Hilliard Spring Branch 19 poles to a rock on the North side of said Spring Branch. Thence N. 87. W. 102 poles to the N.W. corner of my home tract thence S 2 1/2 86 poles to the beginning, containing 30 acres more or less.

Fourth Clause.


I give and bequeath to my son W. P. Holoway and my daughter Maggie Howard W. P. of this county and Maggie of Sequatchie County, Tenn. The following described tract of land which is in the Fifth Dist of Marion County, Tenn and bounded as follows. Beginning at a stake and pointer the Northwest corner of Amanda Davises dower, running thence with dower line S. 79 E 80 poles and 16 links to a stake, thence N. 10 E 50 poles and 20 links to a stake and pointers. Thence N. 79 W. 86 poles to a stake and pointers, Thence S. 3. W 50 poles and 20 links to the beginning.

This tract of land is the same tract that was conveyed from W. E. Harris to me which is not of record in the Registers office in this County the above described tract of land is given to W. P. and Maggie jointly and undivided.

It is my will and desire that my estate pay to W. P. Holloway and my daughter Maggie Howard the sum of One hundred and fifty dollars each at my death, for the purpose of making the value of their portion bequeathed them in this will, equal to the value of the portions allotted to Lillie S.  G. F.  & Joe E. Holoway.

It is further stated in this Will that W. P. Holoway owes my estate at this date the sum of $211.00 for which I attach and itemized statement as an exibit [sic] to this will.
It is my will and desire that W. P. Holoway pay this said sum and interest from this debt to my estate at my death.

It is my will that the tract of land above bequeathed to the said W. P. Holoway be held as security for the payment of the said sum and interest above mentioned and a lien is hereby retained on said land for this purpose.

If the said sum and interest is not paid by the said W. P. Holoway at my death it is my desire that he have a credit on said indebtedness of $150.00 at my death it being the $150.00 bequeathed him in this will.

It is my will and desire that my sons G. F. & J. E. pay me or my estate $20.00 per year from this date to date of my death for the use and benefit of the tracts of land bequeathed them in this will.

It is also my will that my son W. P. have the use and benefit of the land bequeathed him and Maggie Howard jointly, from this date to the date of my death and for which use and benefit he shall pay me or my estate the sum of $20.00 per year.

It is further my will and desire that in the event my estate, after the indebtedness has been paid, is not sufficient to pay Maggie Howard the $150.00 bequeathed her in this will that my sons W. P. & J. E. & G. F. jointly pay her the said sum of $150.00.

The last clause.


In making the foregoing division to my five children I do so without any partiality whatever.

The division made is my best judgement [sic] in the matter. I further desire that my son G. F. Holoway be and he is hereby named as Executor of this will and he is excused from giving bond.

Charge W. P. Holoway ten dollars each year for rent and that to go to Mag Howard he is to pay her Ten dollars a year from the date of the will to my death, what that lacks of $150.00 dollars to Mag Howard pay her the balance out of my estate.

W.P. Holoway has had the use of the Harris place for 8 years. I give him the use of the said place for three years to compensate him for building Barn and other work done on the place and ___ the value of the rent on said place at $20.00 per year this making the total for 3 years $60.00.
