Will of Malinda James

I, Mrs Malinda James. Of the eight Civil District of Marion County State of Tennessee being of
sound mind and memory do make, publish, and declare this to be my last will and testament, to
wit:
First: I resign my soul to my God the one from whom it came
Second All my just debts and funeral expenses shall be first paid
Third: I give, devise and bequeath to my Grand son Alex Anderson and Grand daughter Mary Bell
Anderson son and daughter of Mrs Mary E. Anderson all my real estate where Mary E Anderson
lives now, to be equally devided [sic] between the two, Said tracts containing One Hundred (100)
acres more or less and bounded as follows. On the North by the New Hope school property and
John Graham. On the East by John Graham and Ann Ragsdale, On the South by R. E. Wiswell and on
the East by M. P. James and John Graham said real estate situated in the Eight Civil District,
Marion County, State of Tennessee, to have and to hold said real estate to them, their heirs
and assigns forever and each to have his and her respective half of said real state.
Fourth: I, Mrs Malinda James make this proviso, that Mrs Mary E. Anderson is to have control
and the usufruct of said real estate during her life time, but said life estate to be free and
exempt from all her debts and liabilities and to descend to Alex Anderson and Mary Belle
Anderson at the death of Mrs Mary E. Anderson.
Fifth: I, Mrs Malinda James give, devise and bequeath unto my Grand son Alex Anderson and
Grand daughter Mary Bell Anderson and daughter of Mrs Mary E. Anderson all the state both real
and personal that I may become in possession of or become heir to subsequent to the making of
this will and testament and if any to be equally devided between the two to have and to hold
the same to them, their heirs, assignes [sic] forever.
In witness whereof I have hereunto set my hand of this my last will and testament hereby
revoking all former wills, if any, by me made, This the 9th day of April nineteen hundred and
three (1903)

Signed by the said Mrs Malinda James, as and for her last will and testament in the presences
of us, the undersigned who at her request have subscribed our names hereto as attesting
witnesses the day and date above witnessed.
