Will of John Graham

In the name of God Amen.

I John Graham of the County of Marion in the State of Tennessee do hereby make and publish this my last Will and Testament, hereby revoking and making void any Will or Will’s [sic] heretofore made if any.

Item 1st

It is my Will and desire that my Executors pay my funeral expenses and all my just debts out of the first money coming to their hands from my estate.

Item 2nd

Should I be murdered or my life taken in any unlawful manner, I desire that my executors prosecute the party or parties they believe guilty of the offense that produced my death or any one or more parties they may believe procured it to be done and they are authorized and directed to use so much of my estate as may be necessary to employ counsel to prosecute such party or parties in any or all the Courts of the State where such offense may be commited [sic] and to pay all necessary expenses out of my estate.

Item 3rd

Should I die before my illegitimate son John Graham, born of Matilda Cameron and the same boy I now have at my house and in my control, attains his majority of twenty one years, I desire that my friend and Kinsman William E. Donaldson of Jasper Tennessee take charge and control of my said son, by taking the possession and custody of him, and that he have him educated and fited [sic] not only to become an ornament to society, but to fit him for any proffession [sic] he may desire to enter, and to do all other things necessary to be done for his proper training and education and he is expressly authorized and directed to pay all the necessary expenses of raising, maintaining and educating my said son, out of my estate and his co-executor if any is directed to join with him in making payments out of my estate for the benefit of my said son.

Item 4th

I give, bequeath and devise all the remainder of my estate real and personal and of any nature and character whatever, to my said son, the said John Graham born of Matilda Cameron, but should the said John Graham die without legitimate children living at the time of his death then to my Six Cousins, to wit, Teressa Turney, Aletha Turney, Hannah Turney daughters of Judge Peter Turney of Franklin County, Tennessee, and Ellen Donaldson, Bettie Donaldson and and [sic] Nancy Donaldson daughters of William E Donaldson of Jasper Tennessee share and share alike.

Item 5th

I constitute and appoint Judge Peter Turney and William E Donaldson executors of this my last Will and Testament to which I have subscribed my name in the presence of witnesses on this 14 day of December 1891.

The foregoing instrument was signed by John Graham in our presence and witnessed by us at his request and in his presence and in the presence of each of us on the 14th day of December 1891.
