Will of Eliza Duncan

I, Eliza Duncan being of sound mind and disposing memory do make and publish this my last will and testament revoking all other wills by me at any time made.

I devise to my two sons Robert and Louis Duncan all my real state which is situated in the 8th Civil District of Marion County, Tennessee and on which I now live to be taken and held by them as tenants in common in the following proportions, my said son Robert Duncan shall take a two thirds interest in said real estate and my said son Louis Duncan shall take the remaining one third interest therein.

I direct that my son Robert Duncan out of the property herein devised to him pay to the support of the Roman Catholic Church an annuity of fifteen dollars per year or twenty when able but this bequest shall not be a charge on his real estate should he desire to sell the same but in case of sale he will deposit in bank this amount each year.

After my debts and burial expenses are paid I bequeath all my personal property to my sons Robert and Louis Duncan to be by them taken and held absolutely.

I give and bequeath to my son Peter Magill the sum of fifty (50.00) dollars to be paid to him by my executor out of any money or property in his hands within two years after my death.

I nominate and appoint my son Robert Duncan as my executor to carry out the provisions of this will and I direct that he act without bond.

We Chas C Moore and Matthew Ford hereby certify that Mrs. Eliza Duncan signed the foregoing paper in our presence and acknowledge the same to be her last will and testament, and we hereto subscribe our names as witnesses in the presence of each other and in the presence of the testator.

This is a codicil of my last will and testament. After the business is straightened out $6.00 a year is to be given for a branch to St Joseph’s Church on this side of the river. This mountain land is to be an offset against Louis school money. Louis is to have charge of the buggy to bring the Priest backwards and forwards. It is not to be sold.
