Will of Jackson Pryor

I, Jackson Pryor of Jasper, Tenn, knowing the uncertainty of life and the certainty of death, and being in sound mind and of disposing memory and desiring to make distribution of my real and personal estate, do make and publish this my last will and testament:-

First Clause

I direct that out of the first moneys which come into the hands of my executor my just debts (if any) be paid.

Second Clause

I desire a plain and simple burial and likewise a plain and inexpensive monument, the design, cost, etc, I leave to my wife and my executor.

Third Clause

I give and bequeath to my beloved wife, M. A. Pryor, for and during her natural life all the real estate of which I die seized and posessed [sic] wherever situated (except three town lots hereinafter named). At her death said real estate so devised to my wife I devise and give to Dora C Hale to her sole and separate use, free from the debts or control of her husband in the event of her marriage, and in the event of her death without issue living at that time, then said real estate shall go to Samuel H. Alexander and his heirs.

Fourth Clause

I give and devise to Wm Pryor Lots 105 and 106 in the town of Jasper, Marion County, Tenn and to Samuel H. Alexander the Brick House and Lot in Jasper known as the Pryor Brick.

Fifth Clause

I give and bequeath to my beloved wife, M. A. Pryor, all the household and kitchen furniture, all stock, farming implements, grain and all property in the house or belonging on the farm.

Sixth Clause

I give and bequeath to my beloved wife (to be paid by my executor out of the first moneys which may come into his hands) the sum of One Thousand Dollars, for the use of the family (as now constituted) for and during the first year after my death, if they shall need so much, and if not needed then to be used as my wife in her judgement [sic] may deem best.

Seventh Clause

Out of Moneys and my other personal property (not being before disposed of) such as notes, bonds, etc, I give and bequeath the following sums to the following persons.

To my beloved wife, M. A. Pryor, the sum of ($6000.00) Six Thousand Dollars. (this is in addition to the One Thousand Dollars given in Clause Sixth.

I make no devise or bequeath to my brother Wash Pryor or his children, because my said brother is a man of large property and neither he or his children stand in any need of any gift I might otherwise be disposed to make them.

Eighth Clause

In the event there should be a surplus in the hands of my Executor arising from moneys on hand, collection of notes, sales of bonds, etc, or otherwise after payment of debts, funeral expences [sic] and the payment of the specific legacies then and in that event I desire and direct that said surplus, after payment of the expences [sic] of winding up of my estate, including a reasonable compensation to my Executor for his trouble, shall be divided by said Executor equally and ratably among the following persons:- M. A. Pryor (my wife) E. W. Prigmore, E. W. Prigmore, J. G. Prigmore, J. A. Prigmore, Louisa Richmond, Mary A. Richards, Ruth E. Ely, Mary A. Hilliard, E. G. H. Pryor, S. L. Pryor, Ephriam Pryor, James Pryor, Biddie Pryor, Margaret Pryor, Isabella Pryor, Ruth Vandervert, Laura Pryor, Charles Pryor, Ida O. Mausy, Orpha E. Hale, Dora C. Hale, E. J. Alexander, S. H. Alexander, Estell Bennett, Geo F Alexander, Attye Hall, Mary Jane Pryor, Lennie E. Pryor, Addie Pryor, Carrie Pryor, Ruth Pryor, Laura Pryor, Green H. Pryor. XXXXXXXX.

Ninth Clause

The sums given to those married herein who are females, whether now married or single, are given to them and each of them, to their sole and separate use, free from the debts or control of the present (where married) or any future husband.

Tenth Clause

I nominate and appoint my nephew Samuel H. Alexander the sole Executor of this will, and having faith and confidence in his integrity and business ability, he is excused from giving bond as such Executor, and is given discretion in the collection of notes and sales of bonds, etc.

Codicil made Dec. 5, 1898

Since the making of the above will on Aug 19, 1898, James G. Prigmore, has died having no children and a widow provided for. For these reasons I hereby revoke the above will in so far as it bequeaths Fifteen Hundred Dollars to James G. Prigmore, and now I bequeath to E. W. Prigmore, Two Hundred and Fifty Dollars and to J. A. Prigmore Two Hundred and Fifty Dollars in addition to the amounts given then in the above will, and the residue of the Fifteen Hundred Dollars intended for J. G. Prigmore under the terms of the above will will go into the hands of my Executor to be distributed under the provision of the 8th clause of my will. Dec. 5, 1898.
