Will of E. D. Tate

Special for Lou Rauling’s estate
Kno [sic] all men by these Presence that I E D Tate of the County of Marion and State of Tennessee
a farmer being in ill health but of sound mind and Disposing memory do make and Publish this my
last will and testament hereby revokeing [sic] all former wills here to fore made and as to my
worldly Estate and all Property Real Personal or mixed of which I shall die seized and possessed
on to which I shall be entitled at the time of my decease.
1st
I devise bequeath and dispose their [sic] of in the maner [sic- manner] following to wit
All my just Debts and funeral Expenses shall first by my Executor herein after named be paid
out of my Estate as soon after my Decease as shall by them be found by them convenient. I give
devise and bequeath to my beloved and illegitimate daughter Lou Rollings three Hill Fields two
of which they are now in Possession of in addition the hill below known as the orchard. All the
timbered land that I Possess Lying above the Field also the privaledge [sic] of moveing [sic]
the Smoke House and upper room of where they are know dwelling there in the Rent of the orchard
the present year shall be paid to my Executor. To have and to hold the same to her and her
executors administrators and assigns for ever.
2nd
I give devise & bequeath to my beloved wife Malinda J Tate all my house hold furniture all my
Personal affects what Ever. Also all the Products of my Real Estate to be paid her by my
Executor here in after named to have and to hold to her Executors administrators and assigns
dureing [sic] her natural life. I also give her the use improvements and income of my dwelling
house. At the decease of my wife Malinda J Tate the Property descends by legal coors [sic- course]
of law.
And lastly I do nominate and appoint said son in law L H Martin to be Executor of my Last will
and testament. In testimony where of I the said E D Tate have to this my Last will and testament
contained on one Sheet of Paper there of Subscribe my name and Fixed my seal.
This May the 4th (1895)

Signed sealed and published and declaired [sic] by the said E. D. Tate as his last will and
testament in Presence of us who at his Request and in his Presence and in the Presence of each
other have subscribed our names as witnesses there to
