\nKNOW ALL MEN by these presents, that we, W.M. NELSON and wife, SARA NELSON, for and
\nin consideration of the sum of Twelve hundred nine ($1209.00) dollars, to us cash
\nin hand paid, by H.B. McGARRITY the receipt of which is acknowledged and the
\nfurther consideration of the said H.B. McGARRITY canceling and satisfying and
\naccount, which I owe him the sum of $230.00 we have this day bargained and
\nsold, and do hereby transfer and convey unto the said H.B. McGARRITY, his heirs
\nand assigns, the following tract of land situate, lying, and being in the 11th
\ncivil district of Lauderdale County Tennessee, and is the same tract of land
\nconveyed to W.M. NELSON, by D.M. MITCHELL, by deed of record in the Register’s
\noffice, Ripley Tennessee, in Deed Book U-3, Page 218 and thus described: BEGINNING
\nat a stake in IMRI WEBB’s northwest corner, same being northeast of BURKHEAD
\ntract; running thence west with north boundary of same 64 poles to a stake with
\nwhite oak pointers, the northwest corner of said BURKHEAD tract; thence south
\nwith the road 891\/2 poles to a stake in the road and in DEWALT’s east boundary
\nline; thence east 64 poles to a stake in IMRI WEBB’s west line; thence north 89
\n1\/2 poles to the beginning. Containing 35.80 acres more or less. To have and to
\nhold said tract of land to the said H.B. McGarrity, his heirs and assigns. WE
\ncovenant to and with him, that we are well seized and possessed of said tract of
\nland; that we have a good right to sell and convey the same; that the same is
\nunencumbered, except by a trust deed executed by W.M. OWEN and WIFE to JAMES
\nB.DAVIS, Trustee, to secure a loan to the Federal Land Bank of Louisville, Kentucky
\nand of record in the Register’s office at Ripley, Tennessee, in Federal Land Bank
\ntrust book #2, page 192 to which reference is made and this deed is made and
\nexecuted subject to said deed of trust. AND we further covenant to and with the
\nsaid H.B. McGARRITY, his heirs and assigns, that we will warrant and forever defend
\nthe title to said tract of land against the lawful claims of all persons
\nwhomsoever, except the claim secured by said trust deed, above referred to. WE
\nalso assign and transfer to the said H.B. McGARRITY the stock in the Federal Land
\nBank Association, which was issued with and as a part of said loan secured by
\nsaid deed of trust, above refered to, and the Federal Land Bank is hereby directed
\nto transfer said loan and said stock to the said H.B. McGARRITY. AND SARA
\nNELSON, wife of the said W.M. NELSON, having appeared before me privately and apart
\nfrom her said husband, the said W.M. NELSON, acknowledged the execution of said
\ninstrument to have been done by her freely, voluntarily, and
\nunderstandingly, without compulsion or constraint from her husband, and for the
\npurposes therein expressed. WITNESS my hand and seal of office at office in
\nLauderdale County, Tennessee, this the 28 day of February 1931. C.P. DAVIS Notary
