(1916)"},"content":{"rendered":"<p>STATE OF TENNESSEE; LAUDERDALE COUNTY DEED BOOK H-3 PAGE 365<\/p>\n<p><strong>W.M. NELSON<\/strong> &amp; WIFE TO <strong>A.F. KILPATRICK<\/strong> DEED, 4 1\/2 ACRES. State of<br \/>\nTennessee, Lauderdale County. KNOW ALL MEN by these presents that we<br \/>\nW.M. MORRISON and wife SARAH NELSON for and in consideration of the sum of<br \/>\nSixteen Hundred Dollars to be paid as follows by A.F. KILPATRICK, To Wit: Four<br \/>\nHundred Dollars, to us cash in hand paid by said A.F. KILPATRICK, the receipt of<br \/>\nwhich is hereby acknowledged, and three notes this day executed to W.M. NELSON by<br \/>\nsaid KILPATRICK for the sum of four hundred dollars each and bearing interest<br \/>\nfrom date at rate of 6% per annum and due on the 1st days of December 1917,<br \/>\n1918, 1919, have this day bargained and sold and do hereby transfer and convey<br \/>\nunto said A.K. KILPATRICK, his heirs and assigns two certain tracts of land which<br \/>\nare situated, lying and being in the 5th Civil District of said County and the<br \/>\nfirst tract was conveyed to said W.M. NELSON by MILLER and PARTEE by deed duly<br \/>\nrecorded in the register&#8217;s office at Ripley, Tennessee in Deed Book D-3 Page 329<br \/>\nin which reference is made and said tract is bounded as follows: &#8220;Beginning at a<br \/>\nstake in the center of Cane Slough, being the s.w.cor. of the BILLINGS tract-runs<br \/>\nthence north 28 1\/2 poles to a stake; thence east 18 3\/4 poles to a stake;<br \/>\nthence south 40 poles to a stake in the center of Cane Slough; thence with the<br \/>\nmeanders of Cane Slough to the beginning. Containing about 4 acres more or less.&#8221;<br \/>\nThe second tract adjoins the first tract and was conveyed to said W.M. NELSON by<br \/>\nsaid MILLER and PARTEE by deed duly recorded in the Register&#8217;s Office of said<br \/>\ncounty at Ripley, Tennessee in Deed Book E-3 Page 349 to which reference is<br \/>\nexpressly made and said tract of land is bounded and described as follows to<br \/>\nwit: &#8220;Beginning in the center of Cane Slough the s.e.cor.,of a tract of 4 acres<br \/>\nsold by W.R. MILLER and G.M. PARTEE to W.M. NELSON, thence running in an easterly<br \/>\ndirection down the center of Cane Slough 13 poles to a stake in the center of<br \/>\nCane Slough; thence north 47 1\/2 poles to a small pecan, in the north boundary<br \/>\nline of the BILLINGS tract, of which this is a part, thence west with said north<br \/>\nboundary line 20 poles to a stake the n.e.cor. of the above 4 acres; thence<br \/>\nsouth to the beginning. Containing 4 1\/2 acres more or less. To have and to hold<br \/>\nsaid two above described tracts of land to the said A.F. KILPATRICK his heirs and<br \/>\nassigns forever in fee simple. And we covenant to and with him that we are well<br \/>\nseized and possessed of said land, that we have a good right to sell and convey<br \/>\nthe same; that it is unencumbered and that we will warrant and forever defend<br \/>\nthe title to the same against the lawful claims or all persons whatever except<br \/>\nthe claim for the unpaid purchase money notes hereinbefore referred to. And an<br \/>\nexpress lein is hereby retained on said two tracts of land to secure the payment<br \/>\nof said three purchase money notes hereinbefore referred to and interest until<br \/>\nthe same are paid in full with interest hereinbefore provided. The said<br \/>\nW.M. NELSON retains possession of said land, as tenant of said<br \/>\nA.F. KILPATRICK, until the first day of December 1916 free of any rent, at which<br \/>\ntime he agrees to give immediate possession to said A.F. KILPATRICK. AND SARAH<br \/>\nNELSON joins herein to convey all rights of homestead and all other rights she<br \/>\nhas to said land as wife of said W.M. NELSON or otherwise. This August 17,1916.<br \/>\nW.M. NELSON. MRS.S. NELSON. STATE OF TENNESSEE COUNTY OF LAUDERDALE. This day<br \/>\npersonally appeared before me, HUGH DAVIS, a Notary Public in and for the state<br \/>\nand county aforsaid W.M. NELSON and his wife SARAH NELSON, the within named<br \/>\nbargainors, with whom I am personally acquainted, and who acknowledged that they<br \/>\nexecuted the within instrument for the purposes therein contained. AND SARAH<br \/>\nNELSON, wife of the said W.M.NELSON having appeared before me privately and apart<br \/>\nfrom her said husband, the said SARAH NELSON acknowledged the execution of the<br \/>\nabove instrument to have been done freely, voluntarily and<br \/>\nunderstandingly, without fear, compulsion or constraint from her said husband, and<br \/>\nfor the purposes therein contained. WITNESS my hand and seal of office at Gold<br \/>\nDust, Tennessee, this 17th day of August 1916. HUGH DAVIS, N.P.
