\nPRESENTS, that we H.A. MUELLER and wife, ERA MUELLER for and in consideration of
\nthe sum of FOUR THOUSAND THREE HUNDRED-SEVENTY-SEVEN AND 66\/100 dollars, of which
\namount G.L. FITZGERALD has this day paid to us the sum of SEVENTEEN HUNDRED
\nSEVENTY-SEVEN AND 66\/100 Dollars, in cash, receipt of which is acknowledged, and
\nfor the balance has and does hereby assume the payment of a balance of Twenty
\nSix Hundred Dollars that we owe The Federal Land Bank of Louisville, and which is
\nsecured by first mortgage on the land here conveyed of record in the register’s
\noffice at Ripley, Tennessee to which reference is expressly made. Now for the
\nconsideration aforesaid we have this day bargained and sold and do hereby
\ntransfer and convey unto the said G.L. FITZGERALD his heirs and assigns, a certain
\ntract of land, which is situate, lying and being in the 2nd civil district of said
\ncounty and being the same tract of land conveyed to the said MUELLER by
\nW.B. CAMPBELL and wife by deed of record in the register’s office at
\nRipley, Tennessee in Deed Book J-3 Page 256 to which reference is made and same
\nis described: Beginning at the n.w. cor of a tract of land sold by BENNETT
\nWILLIAMS to G.M. SHAW, thence east with SHAW’s north line 59 1\/4 poles to a
\nstake, SHAW’s n.e. cor thence north 180 poles to a stake,2 elm pointers, thence
\nwest 59 3\/10 poles to a stake with two paw-paw and sweet gum pointers, it being
\nthe n.w. cor.of the original 263 1\/4 acre tract; thence with its western boundary
\nline 180 poles to the beginning. CONTAINING 66 Acres and 96 poles. ALSO a strip
\n10 feet wide and 180 poles long long the west side of said tract and making a
\ntotal of 67 and 1\/3 acres more or less. To have and to hold said tract of land to
\nthe said G.L. FITZGERALD,his heirs and assigns. We covenant to and with him that
\nwe are well seized and possessed of said land: that we have a good right to sell
\nand convey the same; that the same is unencumbered except to said Land Bank as
\nrefered to above,and that we will warrant and forever defend the title to the
\nsame against the lawful claims of all persons whomsoever except the claim of
\nsaid Federal Land Bank. AND the said ERA MUELLER, wife of H.A. MUELLER
\nrelinquishes and conveyed all rights of homestead and dower thar she has in and
\nto said lands, as wife of H.A. MUELLER, and joins in this deed also for the
\npurposes herein expressed. This December 12,1922. $2.00 Revenue Stamps attached
\nand cancelled. H.A. MUELLER. ERA MUELLER.<\/p>\n
\nme, I.M. STEELE, a Notary Public in and for said county H.A. MUELLER and his wife
\nERA MUELLER the within named bargainors, with whom I am personally acquainted, and
\nwho acknowledged that they executed the within instrument for the purposes
\ntherein contained. And ERA MUELLER, wife of H.A. MUELLER having appeared before me
\nprivately and apart from her husband, the said H.A. MUELLER, acknowledged the
\nexecution of the said instrument to have been done by her freely, voluntarily and
\nunderstandingly, without compulsion or constraint from her husband, and for the
\npurposes therein expressed. Witness my hand and seal of office at office in
\nRipley, Tennessee. This 12th day of December 1922. I.M. STEELE Notary Public.
