DEED.91.1 ACRES. KNOW ALL MEN BY<br \/>\nTHESE PRESENTS: For and in consideration of the love which we have for WILLIS<br \/>\nFITZGERALD,son of G.L.FITZGERALD, WE, G.L.FITZGERALD and wife,MRS.MATTIE<br \/>\nFITZGERALD,have this day bargained and sold and do by these presents hereby<br \/>\nbargain,sell,transfer and convey unto the said WILLIS FITZGERALD,his heirs and<br \/>\nassigns forever in fee simple,a certain tract of land,with all improvements<br \/>\nthereon,lying and being in the Fifth Civil District of Lauderdale<br \/>\nCounty,Tennessee,described as follows: BEING a part of 292 acre tract conveyed<br \/>\nby JACOB BYLER to JAMES JOHNSTON, BEGINNING at a stake in a private road<br \/>\nrunning from the Mississippi River back south into the bottom; runs thence south<br \/>\n89 3\/4 degrees west 52 1\/2 poles to a stake in HENRY DAUGHERTY&#8217;s east boundary<br \/>\nline; thence south 4 degrees east with said line 8 1\/2 poles to a stake,said<br \/>\nDAUGHERTY&#8217;s south east corner; thence south 83 3\/4 degrees west with said<br \/>\nDAUGHERTY&#8217;s south boundary line 51 poles to a stake in W.E.LAMBETH&#8217;s east<br \/>\nboundary line,said LAMBETH&#8217;s line 162 1\/5 poles to a stake,the northwest corner<br \/>\nof the KYLE A.STONE tract; thence south 89 degrees east with STONE&#8217;s north<br \/>\nboundary line 71 2\/5 poles to a stake in the road; thence with the meanders of<br \/>\nsaid road as follows; north 9 1\/4 degrees 40 poles,north 3 1\/4 degrees east 30<br \/>\npoles,north 6 3\/4 degrees east 58 4\/5 poles,north 18 degrees east 28 4\/5<br \/>\npoles,north 68 3\/4 degrees west 5 2\/5 poles; thence north 15 3\/4 degrees east 17<br \/>\n64\/100 poles to the BEGINNING,containing 91 1\/10 acres,more or less. TO HAVE AND<br \/>\nTO HOLD said tract of land,with all the improvements thereon,unto the said<br \/>\nWILLIS FITZGERALD,his heirs and assigns forever in fee simple. WE COVENANT that<br \/>\nwe are lawfully seized and possessed of said real estate; that we have a good<br \/>\nand lawful right to sell and convey the same; that the same is<br \/>\nunencumbered,except for 1936 taxes and a Federal Land Bank of<br \/>\nLouisville,Ky.,Deed of Trust of record in the Register&#8217;s office of Lauderdale<br \/>\nCounty,Tennessee,in Realty Trust Book No.__,Pages ___ot seq to which reference<br \/>\nin here made,and that we will warrant and forever defend the title to said real<br \/>\nestate unto said WILLIS FITZGERALD,his heirs and assigns against the lawful<br \/>\nclaims of all other persons whomsoever. AND,MRS.MATTIE FITZGERALD,hereby<br \/>\nexpressly waives all of her rights of homestead and dower in and to said real<br \/>\nestate. IMMEDIATE POSSESSION given the grantee.<\/p>\n<p>THE ABOVE DESCRIBED tract of land is the same tract of land heretofore conveyed<br \/>\nto G.L.FITZGERALD and WILLIS FITZGERALD by deed of MRS.BESSIE PEACOCK of record<br \/>\nin said Register&#8217;s office at Ripley Tenn in Deed Book V-3 Page 625 to which<br \/>\nreference is here made,and by this deed in fee simple title to said real estate<br \/>\nis vested in said WILLIS FITZGERALD,subject alone to the 1936 taxes and said<br \/>\nFederal Land Bank deed of trust; and henceforth he shall have the absolute right<br \/>\nto mortgage,deed,sell,convey,and\/or do with said real estate as he desires.<br \/>\nWITNESS OUR HANDS,this May 12th 1936. G.L.FITZGERALD. MATTIE FITZGERALD. State<br \/>\nof Tennessee Lauderdale County Personally appeared before me,the undersigned<br \/>\nNotary Public in and for said county,G.L.FITZGERALD and his wife,MRS.MATTIE<br \/>\nFITZGERALD,the within named bargainors,with whom I am personally acquainted,and<br \/>\nacknowledged that they executed the within deed for the purposes therein<br \/>\ncontained and as their free act and deed.Witness my hand and seal of office at<br \/>\noffice in Ripley,Tenn.,this May 12th,1936.
