W.M. NELSON et ux TO H.B. McGARRITY DEED to 35.80 ACRES. State of Tennessee.
KNOW ALL MEN by these presents, that we, W.M. NELSON and wife, SARA NELSON, for and
in consideration of the sum of Twelve hundred nine ($1209.00) dollars, to us cash
in hand paid, by H.B. McGARRITY the receipt of which is acknowledged and the
further consideration of the said H.B. McGARRITY canceling and satisfying and
account, which I owe him the sum of $230.00 we have this day bargained and
sold, and do hereby transfer and convey unto the said H.B. McGARRITY, his heirs
and assigns, the following tract of land situate, lying, and being in the 11th
civil district of Lauderdale County Tennessee, and is the same tract of land
conveyed to W.M. NELSON, by D.M. MITCHELL, by deed of record in the Register’s
office, Ripley Tennessee, in Deed Book U-3, Page 218 and thus described: BEGINNING
at a stake in IMRI WEBB’s northwest corner, same being northeast of BURKHEAD
tract; running thence west with north boundary of same 64 poles to a stake with
white oak pointers, the northwest corner of said BURKHEAD tract; thence south
with the road 891/2 poles to a stake in the road and in DEWALT’s east boundary
line; thence east 64 poles to a stake in IMRI WEBB’s west line; thence north 89
1/2 poles to the beginning. Containing 35.80 acres more or less. To have and to
hold said tract of land to the said H.B. McGarrity, his heirs and assigns. WE
covenant to and with him, that we are well seized and possessed of said tract of
land; that we have a good right to sell and convey the same; that the same is
unencumbered, except by a trust deed executed by W.M. OWEN and WIFE to JAMES
B.DAVIS, Trustee, to secure a loan to the Federal Land Bank of Louisville, Kentucky
and of record in the Register’s office at Ripley, Tennessee, in Federal Land Bank
trust book #2, page 192 to which reference is made and this deed is made and
executed subject to said deed of trust. AND we further covenant to and with the
said H.B. McGARRITY, his heirs and assigns, that we will warrant and forever defend
the title to said tract of land against the lawful claims of all persons
whomsoever, except the claim secured by said trust deed, above referred to. WE
also assign and transfer to the said H.B. McGARRITY the stock in the Federal Land
Bank Association, which was issued with and as a part of said loan secured by
said deed of trust, above refered to, and the Federal Land Bank is hereby directed
to transfer said loan and said stock to the said H.B. McGARRITY. AND SARA
NELSON, wife of the said W.M. NELSON, having appeared before me privately and apart
from her said husband, the said W.M. NELSON, acknowledged the execution of said
instrument to have been done by her freely, voluntarily, and
understandingly, without compulsion or constraint from her husband, and for the
purposes therein expressed. WITNESS my hand and seal of office at office in
