G.L.FITZGERALD et ux TO WILLIS FITZGERALD. DEED.91.1 ACRES. KNOW ALL MEN BY
THESE PRESENTS: For and in consideration of the love which we have for WILLIS
FITZGERALD,son of G.L.FITZGERALD, WE, G.L.FITZGERALD and wife,MRS.MATTIE
FITZGERALD,have this day bargained and sold and do by these presents hereby
bargain,sell,transfer and convey unto the said WILLIS FITZGERALD,his heirs and
assigns forever in fee simple,a certain tract of land,with all improvements
thereon,lying and being in the Fifth Civil District of Lauderdale
County,Tennessee,described as follows: BEING a part of 292 acre tract conveyed
by JACOB BYLER to JAMES JOHNSTON, BEGINNING at a stake in a private road
running from the Mississippi River back south into the bottom; runs thence south
89 3/4 degrees west 52 1/2 poles to a stake in HENRY DAUGHERTY’s east boundary
line; thence south 4 degrees east with said line 8 1/2 poles to a stake,said
DAUGHERTY’s south east corner; thence south 83 3/4 degrees west with said
DAUGHERTY’s south boundary line 51 poles to a stake in W.E.LAMBETH’s east
boundary line,said LAMBETH’s line 162 1/5 poles to a stake,the northwest corner
of the KYLE A.STONE tract; thence south 89 degrees east with STONE’s north
boundary line 71 2/5 poles to a stake in the road; thence with the meanders of
said road as follows; north 9 1/4 degrees 40 poles,north 3 1/4 degrees east 30
poles,north 6 3/4 degrees east 58 4/5 poles,north 18 degrees east 28 4/5
poles,north 68 3/4 degrees west 5 2/5 poles; thence north 15 3/4 degrees east 17
64/100 poles to the BEGINNING,containing 91 1/10 acres,more or less. TO HAVE AND
TO HOLD said tract of land,with all the improvements thereon,unto the said
WILLIS FITZGERALD,his heirs and assigns forever in fee simple. WE COVENANT that
we are lawfully seized and possessed of said real estate; that we have a good
and lawful right to sell and convey the same; that the same is
unencumbered,except for 1936 taxes and a Federal Land Bank of
Louisville,Ky.,Deed of Trust of record in the Register’s office of Lauderdale
County,Tennessee,in Realty Trust Book No.__,Pages ___ot seq to which reference
in here made,and that we will warrant and forever defend the title to said real
estate unto said WILLIS FITZGERALD,his heirs and assigns against the lawful
claims of all other persons whomsoever. AND,MRS.MATTIE FITZGERALD,hereby
expressly waives all of her rights of homestead and dower in and to said real
estate. IMMEDIATE POSSESSION given the grantee.
THE ABOVE DESCRIBED tract of land is the same tract of land heretofore conveyed
to G.L.FITZGERALD and WILLIS FITZGERALD by deed of MRS.BESSIE PEACOCK of record
in said Register’s office at Ripley Tenn in Deed Book V-3 Page 625 to which
reference is here made,and by this deed in fee simple title to said real estate
is vested in said WILLIS FITZGERALD,subject alone to the 1936 taxes and said
Federal Land Bank deed of trust; and henceforth he shall have the absolute right
to mortgage,deed,sell,convey,and/or do with said real estate as he desires.
WITNESS OUR HANDS,this May 12th 1936. G.L.FITZGERALD. MATTIE FITZGERALD. State
of Tennessee Lauderdale County Personally appeared before me,the undersigned
Notary Public in and for said county,G.L.FITZGERALD and his wife,MRS.MATTIE
FITZGERALD,the within named bargainors,with whom I am personally acquainted,and
acknowledged that they executed the within deed for the purposes therein
contained and as their free act and deed.Witness my hand and seal of office at
