Elijah FITZGERALD vs heirs and creditors of John L. YARNELL, deceased.
It appearing from the allegations of the complainants bill that the defendants Peter J. O’CLEARY, and wife Mariah O’CLEARY, and C.B. HITT are non-residents of the State of Tennessee, so that the ordinary process of law cannot be served upon them: It is, therefore, ordered that publication be made, for four consecutive weeks, in the Cleveland Banner, a newspaper published in Cleveland, Tennessee, notifying said non-resident defendants to appear at the court house in Ooltewah, on the first Monday in October next, and make defense to complainants bill or the same will be taken as confessed and the cause set for hearing ex parte as to them.
