{"id":968,"date":"2014-01-30T01:55:25","date_gmt":"2014-01-29T23:48:05","guid":{"rendered":"https:\/\/tngenweb.org\/hawkins\/?p=968"},"modified":"2014-01-30T01:56:29","modified_gmt":"2014-01-30T06:56:29","slug":"phillips-john-will","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/hawkins\/phillips-john-will\/","title":{"rendered":"Will of John Phillips"},"content":{"rendered":"<p>Book 2<br \/>\nDated 22 March 1866<\/p>\n<p>State of Tennessee &#8211; Hawkins County<br \/>\nCivil District #1 of said County<\/p>\n<p>I, <span style=\"font-weight: bold\">John Phillips<\/span> of said County and Civil District of aforesaid being of sound mind and memory but feeble in body and by the Grace of God do hereby make and publish by these presents my last will and testament to wit:<\/p>\n<p>My will is that my daughter <span style=\"font-weight: bold\">Susannah Phillips<\/span> to have one bed and bedstead and feather bed, that she made her self, and one milch cow, to have one falling leaf table and one cupboard and table ware, to wit: One set knives and forks, one set tea cups and saucers, one set of table plates, and two dishes, one bureau so as to make her equal with the balance of my children, of what they have already had.<\/p>\n<p>Second &#8211; My will is that <span style=\"font-weight: bold\">Mary Jane Phillips<\/span> my granddaughter, <span style=\"font-weight: bold\">George Phillips<\/span> daughter to have one bed and bedstead and to have one ladies saddle and also to have one heifer which she now claims.<\/p>\n<p>Third &#8211; My will is that my son <span style=\"font-weight: bold\">George Phillips<\/span> is to pay to my estate two hundred dollars to come out of his share of said estate for which I hold a note against him for the same for my part of the mills and the lands appertaining thereto.<\/p>\n<p>Fourth &#8211; My will is that all my just debts and funeral expenses be paid out of the proceeds of my estate.<\/p>\n<p>Fifth &#8211; My will is that my executors or administrators as the case may be, shall sell all my personal property at public sale as usually done on such occasions which is not willed away in this will. And that they sell all my lands that I am seized and possessed of on a twelve month&#8217;s credit and be secured as the law directs.<\/p>\n<p>Sixth &#8211; My will is that my executors or administrators as the case may be is to divide all the proceeds of my estate both real and personal which is made sale of to be divided equal among my several children to wit: <span style=\"font-weight: bold\">George Phillips<\/span>, <span style=\"font-weight: bold\">Susannah Phillips<\/span>, <span style=\"font-weight: bold\">John W. Phillips<\/span>, <span style=\"font-weight: bold\">Mary Harris<\/span>, <span style=\"font-weight: bold\">William Phillips<\/span> heirs, <span style=\"font-weight: bold\">Martin Phillips<\/span>, <span style=\"font-weight: bold\">Isaac Phillips<\/span>, <span style=\"font-weight: bold\">Margaret Ann Beckner<\/span> wife of <span style=\"font-weight: bold\">Perry Beckner<\/span>.<\/p>\n<p>Seventh &#8211; My will is <span style=\"font-weight: bold\">George Phillips<\/span> and <span style=\"font-weight: bold\">Perry Beckner<\/span> be my executors to have full power as heretofore explained is as full and complete a manner as I have myself.<\/p>\n<p>Whereof I do set my hand and seal this 22nd day of March 1866.<\/p>\n<p><span style=\"font-weight: bold\">John<\/span> [<span style=\"font-style: italic\">X<\/span>] <span style=\"font-weight: bold\">Phillips<\/span> (his mark) (Seal)<\/p>\n<p>In presence of us:<\/p>\n<p><span style=\"font-weight: bold\">Nicholas Becker<\/span><br \/>\n<span style=\"font-weight: bold\">Andrew Hill<\/span><\/p>\n<p>State of Tennessee &#8211; Hawkins County &#8211; I <span style=\"font-weight: bold\">John Phillips<\/span> of said County being of sound mind and memory and by the Grace of God do hereby make an alteration in my last will and testament made March 22, 1866 to wit:<\/p>\n<p>I make such alteration as hereafter mentioned.<\/p>\n<p>My will is that my daughter <span style=\"font-weight: bold\">Susan Phillips<\/span> have one hundred acres of my land whereon I now live including all buildings all to be laid off at the directions of my executors at the end of my plantation so as to make the hundred acres so as not to have any scraps of land left at the end of the place so to have and to hold the same free of charge to make a decent support so long as she may live should she outlive me, and the balance to be sold as directed in the first part of the foregoing will made March 22, 1866. And after her death the hundred acres of land to be sold by my executors or administrators as the case may be.
