In the Name of God, Amen.<\/p>\n
I, Samuel Smith<\/span> of State of Tennessee, County of Hawkins, being in a low state of health, but of sound, disposing mind and memory, do make this my last will in manner and form as follows, to wit:<\/p>\n First, I will my body to the dust from whence it came and my soul to God who gave it.<\/p>\n Next, I will all debts and funeral charges be paid by my Executors hereinafter named.<\/p>\n Next, I will to my son Samuel Smith<\/span> one negro man named Jack<\/span> and all my household furniture.<\/p>\n Next, I will a child’s part to my wife Ann Smith<\/span>, as the law directs, if she has not forfeited it by her conduct.<\/p>\n Next, I will an equal division between Henry Law<\/span>, Joseph Hite<\/span>, and the children of Thos. Smith<\/span> of all the balance of my estate.<\/p>\n Next, I will and appoint my son Samuel Smith<\/span> and James Lea<\/span> of Jefferson County my Executors,<\/p>\n and also renders reasons why I do not make an equal divide among the whole heirs, my son Samuel<\/span> has tended more on me in my infirmities than any of the rest, and Henry Law<\/span>, Joseph Hite<\/span> and Thomas Smith<\/span> has had less of my property than the rest and is poorer.<\/p>\n Given under my hand and seal this 6th day of September, 1798.<\/p>\n Samue1 Smith<\/span> L.S.
