{"id":1772,"date":"2014-03-10T19:03:28","date_gmt":"2014-03-10T23:03:28","guid":{"rendered":"https:\/\/tngenweb.org\/hawkins\/?p=1772"},"modified":"2014-03-10T20:36:25","modified_gmt":"2014-03-11T00:36:25","slug":"hamilton-robert-senior-will","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/hawkins\/hamilton-robert-senior-will\/","title":{"rendered":"Will of Robert Hamilton, Senior"},"content":{"rendered":"<p>Will Book ___, Page 236<\/p>\n<p>In the Name of God, Amen.<\/p>\n<p>I<b>, Robert Hamilton, Sen&#8217;r<\/b> of the County of Hawkins and State of Tenn., being in a low state of health &amp; weak in body, but of sound mind &amp; memory, calling to mind the mortality of our nature that it is appointed unto all men once to die, I do ordain this my last Will and Testament in form following to wit:<\/p>\n<p>After commending my soul to God and my body to the dust, to be buried in a decent Christian manner by Christian friends, hoping the will be again united at the general resurrection of the just, I dispose of my worldly goods as follows, Viz:<\/p>\n<p>I allow the first place, all my lawful debts to be paid out of moveable property. I give and bequeath my plantation I live on, on the south bank of Holston containing 225 acres, to my sons <span style=\"font-weight: bold\">Robert<\/span>, he paying his brother <span style=\"font-weight: bold\">John<\/span> who is my son one hundred pounds Virginia money.<\/p>\n<p>Item. I give and bequeath to my son <span style=\"font-weight: bold\">James<\/span> one dollar.<\/p>\n<p>Item. I bequeath to my daughter <span style=\"font-weight: bold\">Catharine<\/span> one dollar.<\/p>\n<p>Item. I bequeath to my daughter <span style=\"font-weight: bold\">Elenor<\/span> one dollar.<\/p>\n<p>Item. I give &amp; bequeath to my daughter <span style=\"font-weight: bold\">Elizabeth<\/span> fifty pounds value in trade to be paid as soon as my two hundred acre survey on the heads of Grassy Creek is sold, to be paid in such trade as rec&#8217;d for the land.<\/p>\n<p>Item. I allow my 400 acre entry on the north bank of Holston, between <span style=\"font-weight: bold\">Thomas Morrison<\/span> &amp; <span style=\"font-weight: bold\">David Kinkead<\/span>, Esq. to be sold and the moneys arising therefrom to be divided as follows, Viz: To my grand children <span style=\"font-weight: bold\">Robert<\/span> and <span style=\"font-weight: bold\">Nathan Page<\/span>, each the sum of $50.00, to be paid in the same kind of pay that is got for the land.<\/p>\n<p>To <span style=\"font-weight: bold\">Robert McWilliams<\/span> and <span style=\"font-weight: bold\">Robert Brushire<\/span> each the sum of ten pounds in like pay as above. To my son <span style=\"font-weight: bold\">John Hamilton<\/span>&#8216;s two sons, <span style=\"font-weight: bold\">Robert<\/span> &amp; <span style=\"font-weight: bold\">William<\/span>, each ten pounds.<\/p>\n<p>I leave the house I now live in &amp; the part of the crop I now receive from my son <span style=\"font-weight: bold\">Robert<\/span>, to wit: One third &amp; all the household &amp; movable property to my wife <span style=\"font-weight: bold\">Margaret<\/span> during her life, cattle and horses inclusive. I leave a judgement I obtained in Sullivan Court against <span style=\"font-weight: bold\">John Snodgrass<\/span> to <span style=\"font-weight: bold\">James McWilliams<\/span>.<\/p>\n<p>I leave my horses, cattle &amp; household furniture after paying all my debts at the death of my wife to be sold &amp; the sums not otherwise appropriated to be divided between my son <span style=\"font-weight: bold\">Robert<\/span>, son <span style=\"font-weight: bold\">John<\/span>, <span style=\"font-weight: bold\">John<\/span>&#8216;s son <span style=\"font-weight: bold\">William<\/span> &amp; <span style=\"font-weight: bold\">John Bershire<\/span>.<\/p>\n<p>I nominate and appoint <span style=\"font-weight: bold\">Samuel McPheeters<\/span>, my son <span style=\"font-weight: bold\">Robert Hamilton<\/span>, <span style=\"font-weight: bold\">George Maxwell<\/span>, my Executors. They or a majority of them to execute this my last Will &amp; Testament,<\/p>\n<p>announcing &amp; Declaring all former wills by me made null &amp; void, and declaring and ratifying this my last Will &amp; Testament.<\/p>\n<p>In testimony whereof I have hereunto set my hand &amp; affixed my seal This 21st day of Feb., A.D. 1800.<\/p>\n<p><span style=\"font-weight: bold\">Robert Hamilton<\/span> (seal)<\/p>\n<p>Test:<\/p>\n<p><span style=\"font-weight: bold\"> Wm. Young<\/span><br \/>\n<span style=\"font-weight: bold\"> John Young<\/span>, Jurat<br \/>\n<span style=\"font-weight: bold\">Robert Young, Jr.<\/span><\/p>\n<p>I, <span style=\"font-weight: bold\">Robert Hamilton, Sr.<\/span>, the Testator of the foregoing Will and Testament, having through the mercy of God survived to the present date and being in sound mind and memory, tho weak in body, I think proper to annex the following alterations to the foregoing will, to wit:<\/p>\n<p>I leave the plantation I live on to my son <span style=\"font-weight: bold\">Robert<\/span> on his paying $100.00 to my son <span style=\"font-weight: bold\">John<\/span> and $10.00 to his eldest son.<\/p>\n<p>I allow my negro wench <span style=\"font-weight: bold\">Silla<\/span> after my death to live with either my son <span style=\"font-weight: bold\">Robert<\/span> or <span style=\"font-weight: bold\">Jesse McWilliams<\/span>, my son-in-law, and the one she lives with shall pay annually to the other $20.00.<\/p>\n<p>I give &amp; bequeath to my daughter <span style=\"font-weight: bold\">Elizabeth<\/span> in lieu of the fifty pounds, one dollar.<\/p>\n<p>My 400-acre entry on the north bank of Holston between <span style=\"font-weight: bold\">Tho&#8217;s Morrison<\/span> and <span style=\"font-weight: bold\">David Kinkead<\/span>, I allow my son <span style=\"font-weight: bold\">Robert<\/span> to sell and (proceeds) as follows: To my son <span style=\"font-weight: bold\">Robert<\/span> $110.00.
