\nProven: May Term 1861<\/p>\n
I, William Carmack<\/b> of the County of Hawkins and State of Tenn. being advanced in years but of sound mind and memory, do hereby make and declare this to be my last Will & Testament, to wit:<\/p>\n
First. I give and bequeath to the heirs of my son Cornelius<\/b>, dec’d the proceeds of a note on my son William E. Carmack<\/b> for $1,000.00 dated February 21, 1861 and due five years after date to be divided amongst the children of said Cornelius Carmack<\/b>, share and share alike.<\/p>\n
Second. I give and bequeath to my daughter Polly Ann<\/b> who married Lewis Long<\/b> one dollar.<\/p>\n
Third. I give and bequeath to my three sons James, Wiley <\/b>& Epps Carmack<\/b> the proceeds of a note on my son William E. Carmack <\/b>for $63.97 due one day after date and dated 23 March, 1861, to be divided equally.<\/p>\n
Fourth. I give and bequeath to my said three sons above named to wit: James, Wiley <\/b>& Epps Carmack<\/b> a Land Warrant issued by the United States to me for 80 acres as the proceeds of said Land Warrant, if sold by me during my lifetime or by my Executor or Administrator after my death to be divided amongst them, share and share alike.<\/p>\n
Fifth. I give and bequeath to my son William E. Carmack<\/b> all the remainder of my estate whatever there may be. Lastly.<\/p>\n
I hereby appoint Cornelius C. Miller<\/b> Executor of this my last Will & Testament, hereby revoking all other wills by me at any time made.<\/p>\n
In testimony whereof I have hereunto set my hand and affixed my seal. This 23rd day of March 1861.<\/p>\n
