{"id":1167,"date":"2014-02-05T12:15:30","date_gmt":"2014-02-05T17:15:30","guid":{"rendered":"https:\/\/tngenweb.org\/hawkins\/?p=1167"},"modified":"2014-02-05T12:15:30","modified_gmt":"2014-02-05T17:15:30","slug":"partition-of-william-kleppers-estate","status":"publish","type":"post","link":"https:\/\/tngenweb.org\/hawkins\/partition-of-william-kleppers-estate\/","title":{"rendered":"Partition of William Klepper&#8217;s Estate"},"content":{"rendered":"<p>Hawkins County records include a document from the probate file entitled <em>In re Estate of William Klepper<\/em>.\u00a0 The document reads as follows:<\/p>\n<p>&#8220;This agreement witnesseth;<\/p>\n<p>&#8220;We the undersigned heirs at law of <strong>William Klepper<\/strong> deceased, who was a citizen of Hawkins County, Tennessee, do hereby agree that <strong>W. F. Phipps<\/strong> county surveyor of Hawkins County togather with <strong>J. G. Lawson<\/strong>, <strong>John M. Klepper<\/strong>, and <strong>W. N. Johnson<\/strong>, citizens and freeholders of Hawkins County, Tenn. shall go upon the lands of the said <strong>William Klepper<\/strong> dec&#8217;d and make partition of same among the six children heirs at law of said <strong>William Klepper<\/strong>, dec&#8217;d and his widow <strong>Nancy J. Klepper<\/strong> who agrees to take a child&#8217;s share.<\/p>\n<p>[&#8230;goes on to commission the four men to divide the land and give a report to the clerk of the county court who would give a decree and issue title to the heirs. The land is described as 336 acres in the 17th District, and gives the adjoining landowners&#8217; names.]<\/p>\n<p>&#8220;Given under our hands and seals this 22nd day of August A.D. 1894.&#8221;<\/p>\n<p>Attest to marks: <strong>T. Klepper<\/strong><br \/>\n[n\u00e9e <strong>Delp<\/strong> &#8211; wife of <strong>Gaines<\/strong>]<\/p>\n<p><strong>Sarah C.<\/strong> <em>X<\/em> <strong>Sizemore<\/strong> (her mark)<br \/>\n[married to <strong>E. D. Sizemore<\/strong>]<\/p>\n<p>&#8220;Personally appeared before me, <strong>T. J. Parrott<\/strong>, clerk of the County court in and for the State &amp; county aforesaid, <strong>Nancy Klepper<\/strong>, <strong>Benjamin Klepper<\/strong> &amp; wife <strong>Mary Ann Klepper<\/strong>, <strong>Isaac R. Courtney<\/strong> &amp; wife <strong>Martha Klepper<\/strong>, <strong>Perry Klepper<\/strong>, <strong>P.T. Klepper<\/strong>, and <strong>Sarah C. Sizemore<\/strong>, the bargainers with whom I am personally acquainted and who acknowledged the execution of the within instrument for the purposes therein contained. And <strong>Mary Ann Klepper<\/strong>, <strong>Martha J. Courtney<\/strong> and <strong>Sarah C. Sizemore<\/strong>, wives of the said <strong>Benjamin Klepper<\/strong>, <strong>Isaac R. Courtney<\/strong>, and <strong>E. D. Sizemore<\/strong> having appeared before me personally and privately and apart from their said husbands, the said <strong>Mary Ann Klepper<\/strong>, <strong>Martha J. Courtney<\/strong> and <strong>Sarah C. Sizemore<\/strong> acknowledged the execution of the within instrument to have been done by them freely, voluntarily, and understandingly, without compulsion of constraint from their husbands and for the purposes therein contained.<\/p>\n<p>&#8220;Witness my hand at office in Rogersville, Tennessee.
