I HENRY A. WELCH being at home and in good health and a Sound mind and well desposing memory do hereby make and publish the following as my last will and testament...

Item 1st I Give to my daughter HENRY ANN OPHELIA WELCH my tract of land of One Hundred acres Known as the COZART tract lying on Cypress Creek in Crocket County to have and to hold the same to her own seperate use and benefit for and during her life also free from the maretel rights of any Husband She may have and after death the same to go to her her Children born of her boddy and in the event she should die without leaving any Children, then the same to be eaqually divided between my remaining Children, and if any one should be dead of them their intrust to go to his or her children.

Item 2d I give to my daughter SALLIE M. HUMPHREYS my tract of land of One Hundred and forty Eight & half acres Known as the PEARSON tract lying in first district of Crocket County to have and to hold to her own Sepurate use and benifit for and during her natural life free from the maretal rights of her present husband or any future husband she may have and after death the same to go her Children...

Item 3 I Give to my son JOHN F. L. WELCH my tract of land of Two hundred & thirty four & half acres of land lying in the 2nd district of Crocket County Known as the SPENCE and BARNETT tracts to have and to hold the same during his natural life and after death the same to go to his Children born in lawfull wedlock and in the event he should die without such Children the same to be Eaqually divided betwen my Children...

Item 4 I Give to my beloved wife MARY J. WELCH my tract of land of of about One hundred and Eighteen or probaly thirty acres lying in the 2nd district of Crocket County Known as the DR. HILL and HARDY land to have and to hold absolutely with the privaliege to seell at any time after my death and reinvest in land if she desires. I also give to my wife MARY J. my home tract of land of about Eight acres in Masons Grove to gether with all my house hold and Kitchen furniture (Peanafort Excepted) also my horse and Buggy & Stock of every descrition.

Item 5 Give my Pianafort to my two Daughters SALLIE and OPHELIA eaqually which either Can Sell her interest to the Other as they may wish.

Item 6 I Give my gold wach to my Son JOHN requesting him to keep the Same in memory of me.

Item 7 any other lands I may own or die seized of I want the Same to be sold by my Executor.

Item 8 It is my will and desire after my death that the lands heretofore Given to my Children in this will be made Eaqual in value...

Item 9 All the remaing part of my Estate which is not hertofore desposed of I will that it be Eaqually divided betwen my Children...

Item 10 It is my will and desire that all bequest & Gifts here Expressed in this will take instant force and Effect I retaining and reserving to act as their agent to manage the property before mentioned from this date.

Lastly I hereby nominate and appoint BENNET SEAT HUMPHRIS my son in law as my Executor to carry out out this will this the 8th Sept 1879.
