Will of Samuel W. Smith - Dated 4 Dec 1883

I, Samuel W. Smith of Crockett County,Tennessee being of sound mind do make this my last will and testament. I give devise and bequeath my estate and property, real and personal as follows -that is to say -

1st It is my will and desire and I hereby set apart one half acre of land for the purpose of a family cemetery, the same being the place where the family grave yard is now located bordering on my east B. line. The same to be used as a perpetual cemetery for my family and descendants.

2nd It my will and desire that after death my executors shall proceed to sell all of my personal and real estate on such terms as they may think best, and the proceeds distributed as follows.

First my burial expenses and all just and lawful claims shall by paid that may come against my estate.

Second, having heretofore given a horse, saddle, and bridle and other gifts to my daughters as follows Mary E. Johnson, Martha J. Smith. Nancy A. Carter, Sarah F. Ezell, and Ada A. Poston. The following of my daughters have not received any such bequests and it being my will and desire that all of my daughters shall share equally in the of my property heretofore as well as hereafter it is my will and desire that the executor of my estate shall pay to Miranda L. Smith, Lucy T.Neal, Laura L. Smith and Lula Smith the sum of one hundred and twenty dollars each. Thinking it will take this amount to make them equal with the aforementioned daughters.
If however during the term of my natural life, I should see fit to make gifts equal to the above named amount to any of my daughters named in the second class as not having received an equal amount with first named shall be debarred from receiving the amount above named and shall be classified with the first mentioned class.

3rd It is my will and desire that after paying all costs and necessary expenses in winding up my estate, the remainder shall be equally divided among my nine daughters to wit, Mary E Johnson, Martha J. Smith, Nancy A. Carter, Sarah F. Ezell, Ada A. Poston, Miranda L. Smith, Lucy T. Neal, Laura L. Smith and Lula Smith.

4th It is my will and desire that all of my property real and personal, the real estate consisting of about one hundred and eighty one acres more or less, shall be exclusively to my daughters. My reason for so doing is as follows. I have heretofore given and deeded to my three sons, John H. Smith, Samuel D.Smith and Robert H. Smith, the following named amounts of real estate.To John H. Smith, thirty three (33) acres, to Samuel D. Smith, thirty five(35) acres and to Robert H. Smith thirty two (32) acres which is all I think they are justly entitled to

5th I appoint John F. Carter and J. B. Ezell of Crockett County, Tenn, my lawful executors to this my last will and testament.

In witness whereof I have signed and sealed and published and declared this instrument as my last will and testament This 4th day of December in the year of our Lord one thousand eight hundred and eighty three

The said Samuel W. Smith of Crockett County Tennessee on the day and date aforementioned signed and sealed this instrument and published and declared the same as his last will and testament and we at his request and in his presence and in the presence of each have hereunto written our names as subscribing witnesses
