THOS. E. NOEL Will Probated November term 1891 Minute Book E. page 547 I, T. E. NOEL of Bells Depot Crockett County Tenn do make this my last will and testament... First I direct that my Executor herein after mentioned shall pay all my individual debts out of my individual money as soon as practicable after my death. Second. I give and bequeath to my wife KATIE NOEL all my House Hold and Kitchen furnature including the Piano also one Horse her choise Buggy & Carriage & harness if on hand at my death... also to her forever my home place in Bells Depot Tenn. consisting of eighteen or twenty acres of land and held by me by several Deeds & upon which is situated three tenant houses also one tract of land lying in the 5th civil District of Haywood County Tenn. known as the SHAW land consisting of about 240 acres and being all the land now owned by me in said District. Item Third. I give and bequeath to LAURA GALLAWAY NOEL my daughter by my pressent wife all the land belonging to me at present? lying in the 6th civil District of Haywood County Tenn and being land purchased by me from HUGHES, BARCROFT, QUINLEY & GRAVES & being about 500 acres. Item Fourth. I give and bequeath to OLIVE NOEL my daughter by my second mariage one tract of land lying in the 12th civil District of Haywood County, Tenn. north of the Forked Deer river consisting of about 150 acres, also one tract tract of land lying in the 14th civil District of Crockett County Tenn known as the MIDYETT land & consists of about 285 acres also one tract of land in the 10th civil District of Crockett County known as the MOODY land consisting of about 185 acres also one tract of land on Black creek lying west of the J. L. POSTON land bought by me from Z. WAINRIGHT also one tract of land lying in the 12th civil District of Crockett County Tenn adjoining the REDDICK land & consists of about 87 � acres. Item Fifth. the above tract of land known at the MIDYETT land is encumbered or rather I am under contract to pay my sister MRS. LUCY SMITH one Hundred Dollars per anum during her life now the said bequest to said 285 acres is conditional that the said OLIVE or her Guardian pay during the life of my said sister, the sum of one Hundred Dollars her annum. Item Sixth. I give and bequeath to my Grand son T. E. NOEL one tract of land lying in the 5th civil District of Crockett County Tenn & bounded on the south by REVEL north by HICKS & contains about 65 acres. Item Seventh. I give and bequeath to my Grand daughter MARY NOEL HARDY on tract of land lying in the 5th civil District of Crockett County Tenn bought by me from MONATGUE et als & contains about 37 acres also one town lot in Bells Depot Tenn bounded by... SIMMONS, MOSS, and ALLEN together with all improvements on same. Item Eight. I give and bequeath to my son EWEL NOEL the store House & lot now used by EWEL NOEL & Co. as a Dry Goods store & being on Main street lying between the house of EWEL NOEL & ANDREWS & Co. Item Ninth. I give and bequeath to my daughter MRS. EDDIE HARDY wife of WALTER HARDY one House and lot lying east of the R. R. & adjoining NEIL & MRS. BUTLER also one vacant lot on Main Street in Bells Tenn. lying between the christain church & the NEIMAN corner. Item Tenth. I give and bequeath to my son EWEL NOEL all my interest in the firm of EWEL NOEL & Co. including all notes and accounts due of the firm ... and I further direct that the firm of EWEL NOEL & Co. be released from any note or notes that may be executed in favor of T. E. NOEL... Item Eleventh. Should there not be sufficient personal assets belonging to my estate at my death to pay all my just debts then I direct and hereby autherize my executor to sell sufficient real estate to realize the required amount and in that event I direct that he sell first the lots herein bequeathed to MRS. EDDIE HARDY then the lots bequeathed to EWEL NOEL then the lands & town lot to MARY NOEL HARDY and last the land bequeathed to my Grand son T. E. NOEL... Item Twelfth. After the payment of my individual debts I direct that the remainder of my estate not otherwise herein bequeathed be distributed as follows one fourth to my wife KATIE NOEL one fourth to my daughter LAURA GALLAWAY NOEL & the remaining one half to my daughter OLIVE. Item Thirteenth. I give and bequeath to my son EWEL NOEL my life Policy he having for some time paid the premium on same. Item Fourteenth. I nominate and appoint my wife KATIE NOEW as the Guardian for my daughter LAURA and direct that she not be required to give bond as such Guardian. Item Fifteenth I nominate and appoint WALTER HARDY as the Guardian of my daughter OLIVE and he is hereby directed to see especialy that she be given the benefit of a liberal education & for this purpose I give and grant him the power to expend such portions of the corpus of her estate as may be nessary... Item Sixteenth. The bequest herin given to my wife KATIE NOEL is intended in lieu of Homestead & Dower and should she accept the same it is to be a waiver and relinquishment of all Homestead & Dower rights. Item Seventeenth. I hereby nominate and appoint my son EWEL NOEL as the Executor of this will... In witness whereof I hereunto sign & publish this instrament as my will this 4th day of July 1871.
