WILLIAM N. HAMILTON - Will - Presented [in Crockett Co.] October Term 1872

I WILLIAM N. HAMILTON of the County of Madison and state of Tennessee do make and publish this my last will and Testament hereby revoking and making Void all other wills by me at any time made.

1st I direct that my funeral expenses and all my other debts be paid as soon after my death as practicable out of any monies I may die possessed of, or may first come into the hands of my Executor.

2nd I will and bequeath to my beloved wife MARY HAMILTON during her natural life or widowhood, the land on which I now live, my negro boy COWPER and such other of my personal property as may be necessary to her comfortable support, which property I hereby direct my Executor to dispose of in any manner he may think best, by her consent (ie) to hire or sell the negro, and sell or rent the Land.

3rd I direct that my Executor sell on the usual terms or in any manner he may think best, such of my personal property and real estate as in his Judgement may not be necessary for the use and Comfortable accommodation of my wife, and that the proceeds of such sale be equally divided among all my children.

4th After the death of my wife, I direct that my Executor sell the balance of my estate whether personal or real, which I may not have previously disposed of and that he sell the same in any manner, and upon any terms he may think best and divide the proceeds among all my children in such a manner that my sons JAMES ABSOLOM's children and ELIGAH have each thirty dollars more than each of their sisters, ELIZABETH, MARY ANN, and PERLINA; and that my son PEYTON have Fity dollars more than each of his brothers, taking in consideration the amount with which I have charged each of my children in my account book kept for that purpose; and further, if any of them shall have received more than his or their part of my Estate according to the above named distribution that he or she or they be charged and refunded the overplus for the benefit of the other Legatees the amount as found in my account book with which each one of my children is charged is as follows JAMES, Seventy six dollars, ABSOLOM Eighty Seven dollars, PEYTON one hundred and one dollars and fifty cents, ELIZABETH Fifty one dollars, MARY ANN Fifty two dollars and PERLINA Fifty four dollars and seventy five cents and I also autherrize my Executor to credit the notes which I shall take of my son and son in law PEYTON and HENRY CLARIDGE for the Land which I have this day deeded to them.

5th and lastly I nominate and appoint my son ELIGAH HAMILTON, Executor to this my last will and Testament. This 28th day of February, 1852.

This is William Newton Hamilton, s.o. William Hamilton and Mary "Unknown" of Chester Co., SC. He is younger brother of my Margaret Hamilton Hefley.

He married Mary Jane McCullough, Sept 8, 1802 in Chester Co., SC. Their children and spouses are as follows;

1-James Hamilton m1: Sarah Warmoth, m 2: Elizabeth unknown

2-Absolom Hamilton m. Olive "Oily" Cutchen

3- Elizabeth Hamilton m. Henry Claridge

4- Elijah Hamilton m. Jane McCrory
