Will of T. W. CROSSNOE
Probated Nov. 12, 1940

I, T. W. CROSSNOE, rializing the uncertainty of life, and being of sound mind and disposing memory do make and Publish this, my last will and testament.

I - I direct that my executors, whom I will hereinafter name and appoint, shall sell all of the Personal Property, owned by me at the time of my death, and with the Proceeds thereof they will pay all of my just debts, including the cost of Administration of my estate, And including all of my funeral expenses.

II -After all of my debts have been paid... if there remains a surplus... then I give and bequeath such surplus to my children, H. N. CROSSNOE, T. W. CROSSNOE, JR., MRS. ERMA CROSSNOE BAXTER, RUFFIN CROSSNOE, FINIS CROSSNOE, MRS. IONA CROSSNOE COMPTON, BENTON CROSSNOE, CLAYBORNE CROSSNOE, MRS. TINNIE CROSSNOE BOYD and FLETCHER CROSSNOE, each of them to share and share a like...

III - To my son HOMER N. CROSSNOE I give and bequeath 12 acres of my home place, which 12 acres adjoins the lands now owned by him...

IV - To my son T. W. CROSSNO, JR., I give and bequeath 12 acres of my home place lying immediately South of the 12 acres which I have given to my son HOMER N. CROSSNOE

V - To my daughter ERMA CROSSNO BAXTER I give and bequeath 12 acres of land lying immediately South of the 12 acres of land which I have given to my son T. W. CROSSNO, JR. ...

VI - To my son RUFFIN CROSSNOE I give and bequeath 12 acres of my home place lying immediately South of the tract of land which I have given by this will to my daughter MRS. ERMA CROSSNO BAXTER...

VII - I give and bequeath to my son FINIS CROSSNO 12 acres of my home place on the South end of the home place, which includes the home dwelling and other out houses and which 12 acres lies immediately South of the 12 acres which I have given by this will to RUFFIN CROSSNO.

I am certain that there are at least 60 acres of land in my home tract which I have given each of the above named 5 children 12 acres, but in event there should be more than 60 acres in said tract, then each of said children shall have an equal share of the excess, but in event the home tract should measure out less than 60 acres, then each 12 acre share shall be reduced so as to make each of said five children have the same amount of land.

VIII - I give and bequeath to my three children, CLAYBORNE CROSSNO, BENTON CROSSNOE and IONA CROSSNO COMPTON jointly share and share alike, the 31 acre tract of land which I own, and which is a part of the home place of my deceased Father and Mother, and which is bounded on the South by the lands of PIERCY and Austin Peay Highway; on the West by the lands of OSCAR BOYD; on the North by the lands of LEE CROSSNO or a road; on the East by the lands of OLLIE BOYD or a road.

IX - To my daughter MRS. TINNIE CROSSNO BOYD I give and bequeath 15 acres of land off the North end of my tract of land known as the part of the old GRANT farm...

X - To my son FLETCHER CROSSNO I give and bequeath 15 acres of land off the South end of the said GRANT tract. This entire tract of land containing 30 acres, more or less, is bounded on the north by OSCAR BOYD; on the East by OSCAR BOYD; on the North by the land of PIERCY and on the west by the land of REAMS...

XI - I anticipate that each and all of my children will be living at my death, but in event either one of them shall predecease me, leaving children, then that part of the real estate herein bequeathed to such an one as may predecease me, shall go to and become the property of their children...

XII - Having full faith and confidence in all of my children, but believing that the oldest and youngest son are the proper ones to Administer and execute this will, I hereby name and appoint my two sons HOMER N. CROSSNO and FINIS CROSSNO as joint Executors of this, my last will and testament...

Having disposed of all of my property as I desire, I declare this to be my last will and testament.

Codicil

I, T. W. CROSSNO, being of sound mind and disposing memory do hereby make and publish this a codicil to my last will and testament, dated December 22, 1937, which said last will and testament is now being held by the Bells Banking Company, Bells, Tennessee for safe-keeping..

I - I do now recite that both before and after the making of my said last will and testament I have become surety on several notes for different ones of my children named in the said will, and it is now my will and I do so direct that if my estate shall become liable under any of such notes, then the portion of my real property given by said will to such child shall be sold first to pay such liability against my estate, and the portions of my real estate given my other children shall only become liable for such debt in the event the share given to the child causing such indebtedness shall not be sufficient to pay the same.

II - I do further give my sons HOMER N. CROSSNO and FINIS CROSSNO, named is said Will as joint executors thereof, the Power, in case the event arises in Item I of this Codicil, to sell the portion of the land belonging to such child given him by said Will, and pay said indebtedness against my estate...

Witness my hand to this Codicil on the 27th day of September 1940.
