Will of EMERY CATES - Probated July 27, 1942 I, EMERY CATES, a resident of Alamo, Crockett County, Tennessee... do make and publish this my last will and testament... Mentions: To my wife, GERTRUDE CATES, all the balance of my personal property... also... the homeplace where we now live in the town of Alamo, Tennessee, on Vine Street, and the only condition that attaches to the devise to her of this homeplace is that, should it be necessary to sell any of my real estate, in order to create funds with which to pay my debts, this said homeplace shall be sold and, in that event, after my debts have been paid, the balance derived from sale of said homeplace shall be hers absolutely. Also... all the balance of my real estate... for her natural life or until she again marries. At the death of my wife, or when she shall have remarried, in either event, I give and bequeath to my son J. B. CATES, 60 acres, more or less, of land situated in the 6th Civil District of Crockett County, Tennessee, on which he now lives... At his death said land shall become the property of my Grandson, JAMES ANDREW CATES. On the death of my said wife or when she remarries, in either event, I give to my Granddaughter, CARRY EUGENE CATES... 50 acres of land located in the 6th Civil District of Crockett Co., known as the NORVILLE tract. 15 acres of land located in the 6th Civil District of Crockett Co., known as the JOHNNY OLIVER land. 63 acres, more of less, of land located in the 7th Civil District of Crockett Co., Conveyed to me by CLAUDE CONLY and C. O. LAMAN. ...With reference to the property bequeathed to my Granddaughter, CARRY EUGENE CATES, that in the event my wife should die or remarry before the said CARRY EUGENE CATES reaches the age of 21 years, I hereby name and appoint, as testamentary trustee, for my said Granddaughter, MISS GLEN CATES (formerly MRS. A. J. RANDOLPH)... Executrix: my beloved wife, GERTRUDE CATES
