September Term 1846

 

State of Tennessee, Benton County, September Term 1846

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in September and it being the 7th day of said Month in the year of our Lord Eighteen hundred & forty six and the 71st year of American Independence.  There being present and presiding on the bench worshipfuls, Esqrs, (to wit) E. Perkins, Nathan Williams and David W. Benton, Justices to hold said Court.

The Clerk of this Court presented a settlement Made with Alexander McRae guardian of the Minor heirs of Mathew Melton deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Joel Rushing guardian of the Minor heirs of Abel Rushing deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with J.A. Browning guardian of J.A. Bomer and Minor which said settlement was examined and approved by the Court and ordered to be recorded.

Previously appeared in open Court William P. Greer guardian of Abram Clement and Made report to this Court that Nothing had yet come into his hands as the effects of said Ward which said report was after being sworn to by the said guardian ordered to be recorded.

On Motion it is ordered by the Court that W.L. Sarratt be appointed overseer of the stage road in room of J.R. Reaves to work from Burnside Creek to Beaverdam Creek, hands as follows; R.N. Wood, Benjamin Holland, William Farrow, Henry Durdin, Zephemiah Collins, James Madden, Alfred Aden, Vincent Horn, Daniel L. Settles, Felix Reaves and all other hands in the bounds shall work under said W.L. Sarratt on said road which is established in the 1st Class.

September Term 1846.

On Motion it is ordered by the Court that William Swindle be appointed overseer of the road to work from Big Cypress Creek to the Natchez Trace road, hands as follows, Nathaniel Nunnery, G.C. Swindle, Isaac Anderson, Zepheriah Barker, hands, Meredith Edwards and John M. Stier shall work under said Swindle on said road which is established in the 2nd Class.

Issued Sept. 8th

On Motion it is ordered by the Court that Etheldred Whitley be appointed overseer of the road to work from Willis Rushing’s to David W. Benton’s – hands as follows; R.P. Rushing, William W. Holland, James H. Vester and all other hands in the bounds shall work under said Whitley on said road which is established in the 3rd Class.

Personally appeared in open Court Amos Bruce, Trustee of Benton County and together with him Seth Utley and D. Brewer his securities who appeared in open Court and acknowledged the due execution of their bond in the sum of Nineteen hundred dollars for the purpose of drawing the school fund due the County of Benton for the year 1846 conditioned as the law directs.

D.P. Hudson one of the Committee who was appointed at a former term of this Court to Make settlement with the Commissioners of the Town of Camden returned into Court the settlement so Made which was examined and non-concurred in by the Court.  And it is ordered by the Court that said Committee with A.C. Presson who is hereby added to their body proceed to reconsider and Make new this settlement and that they Make report to the next term of this Court.

On Motion it is ordered by the Court that Chesterfield Melton be appointed overseer of the road to work from Nancy McKenzie’s to Wyatt’s Bridge, hands as follows; A.P. Smith, Neil McNeil, Ezekiel McBride, John Wyatt, James Yarbrough, Daniel Buchanan, Robert Graham, Daniel Graham, Lauflin Beaton, Malcom Beaton, Thomas Pitt, Alsey McDaniel and all other hands in the bounds shall work under said Chesterfield Melton on said road which is established in the 2nd Class.

September Term 1846

Personally appeared in open Court Sarah Hatley guardian of Stafford Hatley and together with her Seth Utley and John Gossett her securities who appeared in open Court and acknowledged the due execution of their bonds in the penal sum of Two hundred & sixty dollars conditioned as the law directs.

Personally appeared in open Court John Phifer, Administrator of the estate of Peter Phifer deceased and returned a sale bill of the property of said estate and oath being Made to the same it is ordered to be recorded.

On Motion it is ordered by the Court that James Childers be appointed overseer of the road to work from Vinegar Hill to the Carroll Country line and all the hands that formerly worked under Henry Abbott on said road or in the bounds shall now work under James Childers on said road which is established in the 2nd Class.

On Motion it is ordered by the Court that A.J. Hudson be appointed overseer of the road to work form the Town of Camden to Samuel Crockett’s old place, hands as follows; Samuel Crockett, Spartan Bruce, John Higdon, James G. Hudson, John H. Hudson, James C. Wright, Henry Stegall, John T. Presson, William A. Steel and the hands that may reside there and all the hands on the Branch above said Steel’s and all other hands in the bounds shall work under said Hudson on said road which is established in the 2nd Class.

Issued Sept. 9th.

On Motion it is ordered by the Court that Needham Short, be appointed overseer of the road to work from the Creek near Samuel B. Pearces’s to L.H. Pope’s, hand as follows; L.H. Pope, Geo. W. Killbreath, Albert Aden, Josiah Forester, John Marchbanks, Giles Marchbanks, Ruffin Jordan, Meshack Dean and all other hands in the bounds shall work under said Short on road which is established in the 2nd Class.

Issued Sept. 9th.

Personally appeared in open Court John F. Johnson guardian of the Minor heirs of William B. Griffis deceased and together with him D. Brewer and Laton Pearce his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars conditioned as the law directs.

September Term 1846

On Motion it is ordered by the Court that Hillsman King be appointed overseer of the road to work from Darby’s old place to Nivin’s, hands as follows, James Nivens, J.W.P. Lewis, Henry Lewis, William Lewis, John Hamilton and Alfred Nivins & H. Makins.  All other hands in the bounds shall work under said King on said road which is established in the 2nd Class.

Issued Sept. 9th.

This day personally appeared in open Court Zecheriah Thomas, the stepfather of William, Nancy, Caroline, John L.F. and Lucinda Dickerson and prayed the Court to bind said children out as law directs, and thereupon, Sion Melton appeared in open Court and entered into an indenture for William about 14 years of age and Nancy Caroline about eight years of age to whom said children were bound as the law directs, also Conrad Melton appeared in open Court and entered into an indenture for John L.F. and Lucinda Dickerson, John L.F. aged about eleven years and Lucinda about ten years to whom said children were bound as the law directs.

On Motion it is ordered by the Court that Isaac Davidson be appointed overseer of the road to work from Ross Ferry to Chalk Level, hands as follows; George Thomason, Stephen Marchbanks, William Harden, John Harden, John Ford, John Waldrop, Andrew Smith, James Smith, William Ballowe, Thomas Ballowe, John Ballowe, Samuel Ballowe, L.D. Combs, James Wyly & hands and all other hands in the bounds shall work under said Davidson on said road which is established in the 2nd Class.

Issued Sept. 9th.

Court then adjourned until Court in Course.
