October Term 1844

Know all Men by these presents that We, Ephraim Perkins, E.F. Wills, Beverly Herron, Nicholas Brewer, Wm. K. Perkins, Wm. M. McAuley, S.H. Davidson, James Presson, Wm. J. Greer and Robert H. Hawthorn, all of the County of Benton and State of Tennessee are held and firmly bound into the State of Tennessee in the penal sum of Twenty thousand dollars for the payment of which well and truly to be Made we bind ourselves, our heirs and legal representatives sealed with our seals and dated this the 7th day of October 1844.

The condition of the above obligation is such that whereas the above bound Ephraim Perkins was at the January Term of the County Court for Benton County 1844 duly elected entrytaker for said County of Benton for four years from his said election.  Now if the said Ephraim Perkins does faithfully account for and pay over according to law all Money by him Collected by virtue of his said office of Entrytaker and do and perform all the duties enjoined on him by law as such Entrytaker then the above obligation to be void otherwise to remain in full force and effect.

And it is ordered by the Court that W.A. Steele be released from further, liability on said Bond.

The Court then proceeded to make an appropriation to John Wynn for keeping Nancy French a pauper of said County the ensuing year and there being present and presiding on the bench the following Esqrs. (Viz.) D.P. Hudson, E. Perkins, Nathan Williams, William Barnes, S.H. Davidson, Wm. M. McAuley, John W. Davidson, J.D. Rushing, Hezekiah Greer, Geo. W. Farmer, Elijah Alsop, 10- Being a Majority of all the Justices in Benton County and all voting in the affirmative.  It is therefore ordered by the Court that the said John Wynn be allowed and paid the sum of Thirty dollars and that the Trustee pay the same out of any Money in the treasury for the payment of paupers not otherwise appropriated.

October Term 1844

The Clerk of the Circuit Court presented to this Court certain bills of cost accruing in the Circuit Court and certified by the Atto. General for which he wanted an allowance Made by this Court and to be paid by the Trustee of this County and the votes being called those who voted in the affirmative are Esqrs. E. Perkins, Nathan Williams, William Barnes, S.H. Davidson, W.M. McAuley, John W. Davidson, John D. Rushing, Hezekiah Greer and Elijah Alsop 9, Geo. W. Farmer voting in the Negative.  A Majority of all the Justices in Benton County Not voting in the affirmative.  It is therefore ordered by the Court that said appropriation be not allowed.

The Court then proceeded to Make an appropriation to W. P. Morris, Clerk of this Court for sundry services rendered by said Clerk (viz) for recording the report of the common school commissioners and copy to the superintendent for settlement with Trustee touching his receipts & disbursements of the common school fund & Trustees bond to draw said fund $7.00 and for 102 Jury Tickets at 64 cts. each – 6.37˝  Making in all thirteen dollars & 37˝ and there being present and presiding on the bench the following Justices (viz.) D.P. Hudson, E. Perkins, Nathan Williams, William Barnes, S.H. Davidson, W.M. McAuley, John W. Davidson, John D. Rushing, Hezekiah Greer, Geo. W. Farmer & Elijah Alsop 10- Being a Majority of all the Justices in said County and all voting in the affirmative. It is therefore ordered by the Court that the above sum of Thirteen dollars & 37˝ cents be allowed & paid by the Treasury for general County purposes Not otherwise appropriated,

Personally appeared in open Court Wm. J. Greer administrator of the estate of Jose C. Melton deceased and Made return of the inventory and account of sale of said estate and oath having been Made, It is ordered by the Court to be entered of record.

October Term 1844

Personally appeared in open Court John F. Johnson guardian of the Minor heirs of Wm. G. Griffis deceased and together with him Levin Cottingham and W.A. Steele his securities appeared in open Court and acknowledged the due execution of their bond in the penal sum of Two hundred dollars conditioned for the faithful performance of his said guardianship.

Personally appeared in open Court John Atchison Constable for the fifth Civil District of Benton County and tendered his resignation as such constable which was received and it is ordered by the Court that the Sheriff proceed forthwith to open and hold an election to fill said vacancy.

The Court proceeded to appoint Judges to preside at the election to be held in Benton County on the fifth day of November Next for the purpose of elections to elect a President and Vice President of the United States and the following Gentlemen were appointed (viz)

1st District - James White, B.B. Barnett, Wm. Hubbs                                                                     2ndDistrict - James Evans, Henry B. Lawrence, James Merrick.                                                     3rd District - Henry Barnes, S. H. Davidson, William Ballowe Sr.                                                  4th District - J.J. Cole, John F. Johnston, James Allen.                                                                    5th District - W.M. Sarrett; Willis Rushing, James Gordon.                                                            6th District - James K. Nance, Benjamin Greer, John Watson.                                                        7th District - Berry Vesser, John Melton, Etheldred Melton.                                                           8th District - William Wannaok, Alford Brewer, Alex McRae.                                                       9th District -  Dennis Stockdale, William Wright, Malcom Beaton.

The Court then proceeded to appoint a Jury to serve at the Next term of the Circuit Court to be held for the County of Benton at the Courthouse in the Town of Camden on the 2nd Monday in January Next and the following Gentlemen were appointed as Jurors to serve at said term (viz)

1st District - Mansfield Mussey, Elijah Woods.                                                                              2nd Dist.     - B. Beard, Theophilus Kirk.                                                                                          3rd Dist.     - Stephen Marchbanks, John Cravin, N. Nunnery.                                                         4th Dist.     - Green Flowers, John F. officer and that a Venire facias issue.

October Term 1844

On Motion it is ordered by the Court that John Cravins be appointed overseer of the Ross's Ferry road leading from Huntingdon to said ferry by the way of Roland's Mill to commence where the Lexington road Crosses said road and work to Chalk Level and that the following hands under said Cravins on said road (viz) Holloway Kee, Hinton H. Mitchell, John Pinkston, Solomon Cravins, Middleton Thomason, Amos Roland, John Mothershead, John Lewis and all other hands in the bounds shall work under said Cravin on said road which is established in the 2nd Class.

In persuance of an order of Court the Sheriff proceeded to let out William Rushing a pauper of Benton County to the lowest bidder and he reports to the Court that Elijah Alsop being the last and lowest bidder agrees to keep said Rushing twelve months for the sun of forty three dollars.  Whereupon it is ordered by the Court a Majority of all the Justices in Benton County on the bench & all voting in the affirmative that the above sum of forty three dollars be allowed & paid said Alsop by the Trustee of Benton County out of any Money in the Treasury for the payment of Paupers Not otherwise appropriated.

Court then adjourned until tomorrow morning 9 o'clock.

Personally appeared in open Court, John Gossett who was this day appointed guardian of the Minor heirs of  James Malin deceased and together with him Pleasant Mullincks his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of two hundred dollars conditioned for the faithful performance of his said guardianship.

October Term 1844.

The Clerk of this Court presented a settlement Made with Levin Cottingham, Administrator of the estate of William Pickler deceased which said settlement was examined and concured in by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Wm. M. Malin, administrator of the estate of James Malin deceased which said settlement was examined and concured in by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with James Walker Administrator of the estate of Geo. W. Barnett deceased which said settlement was examined and concured in by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with J. W. Hill and J.M. Reaves executors of the estate of Margaret Currie deceased which said settlement was examined & concured in by the Court and ordered to be recorded.

The Clerk of this Court prsented a settlement Made with M.C. Barnett guardian of James Harrison which said settlement was examined and concured in by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Mary Barnett guardian.

The Clerk of this Court presented a settlement with Charles Cowell guardian which said settlement was examined and concurred in by the Court and ordered to be recorded.

October Term 1844.

On Motion it is ordered by the Court that Henry Stegall be appointed overseer of the road to work from the forks of the road at the head of the race track to William Watson's, hands as follows; William Watson, Wm. H. Presson, John T. Presson, A. Presson, William Armor, Oliver Armor, Robert Armor, John Pearce, Henry Allen, John H. Hudson, James Wright and all other hands in these bounds shall work under said Stigall on said road which is established in the 1st Class.

On Motion it is ordered by the Court that R.S. Ward, John T. Presson Jr. Jesse McGill, D.C. Rushing, Wm. Turner, Robert L. Ward and Robert Ward be appointed a Jury of Review to view and Mark an alteration in the road leading from Camden to Pearce's Bridge commencing at the corner of Hezekiah Greer's fence and intersect the old road near top of the ridge towards Wm. Waters and Make report to the Next term of this Court.

On Motion it is ordered by the Court that Thomas Ward be appointed overseer of the road to work from Hezekiah Greer's to Pearce's Bridge on Sandy, hands as follows; Geo. W. Rushing, James A. Greer, John T. Presson Jr., A.C. Presson, Johnathan J. Rushing, Thomas Presson, David Watson, David Watson Jr., Isaac Watson, James Watson, Robert Ward, Jesse McGill, David McGill, James Grosno, Allen D. Grossno, William Turner, John Pearce Jr., Joseph J. Bain, David Niceler, Willie B. Eddington and all other hands in these bounds shall work under said Ward on said road which is established in the 1st Class.

It is ordered by the Court that if the Jury of Review appointed to view an alteration in said road agree to alter it the overseer will proceed to open it accordingly.

October Term 1844

Personally appeared in open Court Samuel G. Tittle who was this day chosen and appointed guardian for Martha Jane Tittle and together and together with him John W. Utley his security who appeared in open Court and acknowledged the due execution of their bond in the penal sum of three hundred dollars conditioned for his faithful performance of said guardianship.

On Motion it is ordered by the Court that the overseer and hands that now work the road from Cottingham’s Mill to the stage road be released from any further work on said road and from all liability for failing to keep said road.

Court then adjourned until Court in Course.
