May Term 1843

 

State of Tennessee, Benton County, May Term 1843

At a County Court began and held for the County of Benton at the Court House in the town of Camden on the first Monday in May it being the 1st day of said Month in the year of our Lord one thousand Eight hundred & forty three and the 67th year of American Independence there being present and presiding on the bench the worshipfuls, Esquires E. Perkins, Chairman D.P. Hudson, Nathan Williams.

On Motion of John Bell and Joseah T. Florrence who Made oath according to law and together with M. Smith Corbitt and Lewis W. Brewer their security appearing in open and entered into and acknowledged their bond in the sum of one Thousand dollars conditioned as the law directs.  It is ordered by the Court that said John Bell and Joseph T. Florrence of have letters of administration upon the Estate of George Bell deceased to be Made out in due form when required.

The Clerk of this Court presented to the Court a settlement Made with Rickey W. Rowe Executor of William Walker dec’d. by George R. Kelsey former clerk of this County and the same having been examined and concurred in by the Court.  It is ordered that the same be recorded.

May Term 1843

The Clerk of this Court requested to the Court a settlement prorata Made by himself with John Buchanan Administrator of the Estate of John B. Graham deceased and the same having been examined and concurred in by the court.  It is ordered that the same be recorded.

The clerk of this Court presented a settlement prorata Made by D.P. Hudson, R.W. Alto, and A.C. Presson Commissioners operated to Make prorata distribution with J.D. Rushing, Administrator of the estate of Thos. McGill deceased and the same having been examined & concurred in by the Court.  It is ordered to be entered of record.

The Clerk of this Court presented to the Court a settlement Made with Lenard H. Pope Administrator of the Estate of Simon Pope deceased by Geo. P. Kelsy former Clerk of this Court and the same having been examined and concured in by the Court.  It is ordered to be recorded.

The Clerk of this Court presented to the Court a settlement Made with Sarah Hatley Guardian of the Minor heirs of H. Hatley deceased by G.R. Kelsey former clerk of this Court and the same having been examined by the Court it is rejected by the Court in consequence of error in said settlement.

On Motion of James Presson to alter and change that part of the stage road between T. Jones & the said Presson it is ordered by the Court that the following persons be appointed a jury of Review to Mark and make said Alteration (to wit) Thomas Jones, Sol. Wiseman, Oliver William Stewart and William Wiseman and Make return to the Next term of this Court.

Issued 1st May.

On Motion it is ordered by the Court that Berry Williams, Nathaniel Nunnery, Thomas Swindle, Cullen Nowell, William Swindle, James Merrick and Alfred Harris to Review and Make out such alterations of the road as they may think proper & best for the public from Berry Williams to Flowers Mill on Birdsong and Make return of the same to the next term of this Court.

May Term 1843

On Motion it is ordered by the Court that I.B. Carns be appointed overseer of the stage road in room of J. Johnson to work from the foot of the hill at Thomas McGill’s to the Creek this side of Thos. Jones and that the following hands work under said Carnes on said road (to wit) A. Lashlee, and hands, C.K. Wyly, James Gorden, J.W. Johnson, A.S. Cole, N.M. McCarroll hands, G.W. Cook, John Davidson, John Atchison, B. Hardy, A.R. Carnes, Joseph Wiseman, C.A. Crawley, E.F. Carroll, Whitman Rushing, May Sarratts hands, C.M. Sarratt, Daniel McElyea, Asbury, McElyea and all other hands in the bounds work under said Carroll on said road which is Established in the 1st Class.

The Revenue Commissioners presented a settlement Made with the Trustee of this County which settlement was rejected and it is ordered by the Court that the Clerk certify to the Trustee an aggregate amt of the County taxes payable to the Trustee and also that the part of taxes for building the Court house to the Commissioners of the town of Camden and that the Commissioners proceed to make settlement with the Trustee Accordingly.  Court then adjourned until Court in course.
