March Term 1847

 

State of Tennessee, Benton County, March Term 1847

At a County Court began and held for the County of Benton at the Courthouse in the Town of Camden on the first Monday in March it being the first day of said Month in the year of our Lord Eighteen hundred & forty seven and 71st year of American Independence, their being present and presiding on the bench the worshipfuls, Esqrs, (to wit) Elijah Alsop, Nathan Williams and John W. Davidson.

The Clerk of this Court presented a settlement Made with Charles H. Thompson, Administrator of the estate of William Thompson deceased which said settlement was examined and approved by the Court and ordered to be recorded.

The Clerk of this Court presented a settlement Made with Amos Bruce and Wilson M. Sarrett Administrators of the estate of Mary Sarrett deceased with the will annexed of John Sarrett deceased which said settlement was examined and approved and ordered to be recorded.

On Motion it is ordered by the Court that John H. Wiseman be appointed overseer of the Travis Mill road to work from Thomas Jones’ to John H. Williams, hands as follows; William D. Wiseman, John Wiseman, Milton Wiseman and A. Wiseman shall work under said Williams on said road which is established in the 2nd Class.

Issued March 3rd.

Personally appeared in open Court Meriah Capps one of the Administrators of the estate of Hillary Capps deceased and prayed to be released from her bond as such administratrix which said petition is received by the Court and it is ordered by the Court that she be henceforth released from all further liability on her bond as such Administratrix.

Personally appeared in open Court Meriah Capps who was this day appointed guardian of the Minor heirs of Hillary Capps deceased (to wit) Susan J. Capps, John B. Capps, James B. Capps, Sarah E. Capps, Mary Ann Capps and Francis M. Capps and together with her Joseph Wiseman, Irvin B. Carnes and John W. Utley her securities who appeared in open Court and entered into and acknowledged the due execution of their bond in the penal sum of seven hundred dollars conditioned as the law directs.

March Term 1847.

On Motion it is ordered by the Court that William J. Turner be appointed overseer of the road to work from Hezekiah Greer’s to Pearce’s Bridge, hands as follows; David Rushing, Thomas Presson, David Watson, David Watson, Jr., Isaac Watson, James Watson, Jesse McGill, James Crossno, Allen D. Crossno, Joseph T. Bane, Thomas Ward and all other hands in the bounds shall under said Turner on said road which is established in the 2nd Class.

State of Tennessee, Benton County

Be it known at a County Court of Monthly Sessions held at the Courthouse in the Town of Camden in said County on the first Monday in March A.D. 1847.  Being the first day of said Month that satisfactory evidence was adduced in open Court to prove and did prove to the satisfaction of said Court that John Sarrett was a pensioner of the United States and died on the 7th day of September 1834 – that at the time of his death he left a widow Mary Sarrett who survived him unmarried until the 19th of October 1843.  At which time the said Mary died leaving the following named children surving (to wit) Elizabeth Browning, formerly Elizabeth Sarrett, Joseph Sarrett, William M. Sarrett, Parthena Sarrett, Charles M. Sarrett, Attilla Bruce, formerly Attilla Sarrett, Mary Lashlee, formerly Mary Sarrett, Eliza Stephenson, formerly Eliza Sarrett and who are still living (except Mary Lashlee) and the said Mary had also the following named children who had died previous to the death of the said Mary (to wit) Sarah Sarrett and John B. Sarrett.

Personally appeared in open Court Allen C. Presson, Administrator of the estate of Mary Cottingham deceased and returned a sale bill of the property & effects of said estate and oath having been Made to same it is ordered by the Court to be recorded.

Personally appeared in open Court Bird B. Barnett who was this day appointed guardian of the Minor heirs of James Malin deceased and together with him Wm. M. Malin and M.C. Barnett his securities who appeared in open Court and acknowledged the due execution of their bond in the penal sum of seven hundred dollars conditioned as the law directs.

On Motion  it is ordered by the Court that A.R. Carnes be appointed overseer of the road work from the town of Camden to Burnside Creek, hands as follows; David Holland, C.M. Sarrett, A.F. Benton’s hands, M.L. Travis and all other hands in the bounds shall work under said A.R. Carnes on said road which is established in the 1st Class.

March Term 1847.

On Motion it is ordered by the Court that Michael Fry, Neil McDaniel, Wm. Hubbs, Bird B. Barnett, Hillary Crabb, Thomas McGill, James White and Wesley Matlock be appointed a Jury of review to view and Mark an alteration in the Hubbs Ferry road beginning at or near the widow Matlock’s and run so as to intersect the old road at or near William M. Malin and to make return to the next term of this Court of the advantages and disadvantages arising to the public and to individuals.

Court then adjourned until Court in Course.

State of Tennessee

Know all men by these presents that we Roland Rushing, John D. Rushing, Levin Cottingham, John W. Utley & Seth Utley – All of the County of Benton are held and firmly bound unto Aron V. Brown, Governor of said State for the time being and his successors in office in the penal sum of Five hundred dollars in payment of which well and truly to be Made we bind ourselves, our heirs and Representatives jointly & severally firmly by these presents sealed with our seals and dated this 5th day of April 1847.

The condition of the above obligation is such that whereas the above bound Roland Rushing was at the January term of the County Court of Bentoon County duly and lawfully elected Collector of the public and County taxes for said County of Benton for the year 1847.  Now if the said Roland Rushing shall well and truly collect all State taxes and also all taxes on school lands within said County which by law he ought to collect and shall account for and pay over all taxes by him Collected or which ought to have been collected by the first day of December 1847 into the hands of the treasurer of Tennessee then the above obligations to be void otherwise to remain in full force and effect.
