March Term 1846

 

State of Tennessee, Benton County, March Term 1846.

 

At a County Court began and held for the County of Benton at the Courthouse in the

Town of Camden on the first Monday in March, it being the 2nd day of said Month in the

year of our Lord eighteen hundred & forty six and 70th year of American Independence

there being present and presiding on the bench the worshipfuls, Esqrs,; (to wit) E.

Perkins. Chairman, Johnathan K. Thomas and Samuel H. Davidson.

 

The Clerk of this Court presented a settlement Made with L.H. Pope, administrator of the

estate of Simeon Pope deceased which said settlement was examined and approved by

the Court and ordered to be recorded.

 

On Motion it is ordered by the Court that David Rushing be appointed overseer of the

road in room of John Thomton to work from Hezekiah Greer to Pearce's Bridge, hands as

follows; J.J. Rushing, Thomas Presson, David Watson, David Watson, Jr., Isaac Watson,

Jess McGill, David McGill, James Crossno, Alien D. Crossno, Joseph J. Bain, Thomas

Ward and all other hands in the bounds shall work under said Rushing on said road whish

is established in the 2nd Class.

 

On Motion it is ordered by the Court that Lewis Roswwell work under John H. Williams

as overseer of the road and that he be released from James CowelPs orders.

On Motion it is ordered by the Court that the road leading from Elisha Herron's to

Wyatfs Bridge on Sandy be annulled and continued no longer as a highway of this

County.

 

Personally appeared in open Court, Ira Love, who was this day appointed guardian of

William Love and together with him Jesse Stafford, Barrett Stafford and David Brewer

his securities who appeared in open Court and acknowledged the due execution of their

bond in the penal sum of Fifteen hundred dollars conditioned as the law directs.

March Term 1846

 

Upon the application of Daniel F. McElyea, who this day gave information to the Court

here that one Jordan Click, a Minor about the age of twelve years was destitute of

sufficient vituals, clothing &c, and that his mother was totally unable to provide for said

boy the common necessities of life and this information having been supported by the

testamony James R. Childers it is considered by the Court that said Jordan Click should

be bound and thereupon he was bound to Daniel F. McElyea who appeared in open Court

and together with him Timothy Reaves his security who appeared in open Court and

acknowledged their bond conditioned that the said Daniel F. McElyea will teach said

apprentice art and Mystery of a blacksmith and teach or have him taught the arithmetic to

the rule of three and when he arrives at the age of Twenty one to give him a good set of

Smith tools, and two good suits of clothes and during his apprenticeship shall constantly

provide him, the said apprentice, with sufficient diet, washing, clothing & lodging

suitable to an apprentice.

 

Personally appeared in open Court Wm. A. Smally, Justice of the peace in the 8th Civil

District of Benton County and tendered his resignation as such which was received and it

is ordered by the Court that the Sheriff proceed forth to open and hold an election to fill

said vacancy.

 

On Motion it is ordered by the Court that Ichabod Farmer be appointed overseer of the

road to work from Samuel Benton's to Davidson's ferry on Tennessee River and all the

hands that formerly worked under Joseph Benton or in the bounds shall now work under

said Farmer on said road which is established in the 2nd Class.

 

On Motion it is ordered by the Court that J.A. Jordan be appointed overseer of the road in

room of Hyram Haynes to work from Sycamore Creek to Carroll County line and all the

hands that formerly worked under said Haynes or in the bounds shall now work under

said Jordan on said road which is established in the 2nd Class.

March Term 1846.

 

Personally appeared in open Court John McGill and James Crossno, administrators of the

estate of Henry Nisler, deceased and made return of the sale bill of the property of said

estate and oath having been made to the same it is ordered by the Court to be recorded.

A.C. Presson one of the Commissioners who was appointed at a former term of this Court

to lay off and set apart a sufficiency of provisions to serve the widow and family of

Henry Nisler deceased Made report to this Court which is ordered to be recorded.

 

John G. Allen one of the Commissioners who was appointed at a former term of Court to

lay off and set apart a sufficiency of provisions to serve the widow and family of Isham

Jones deceased Made report to this Court which was ordered by the Court to be recorded.

 

Personally appeared in open Court John Buchanan R.C. in the 9th district Eligah Alsop

Rev. C. in the 8th Civil district John W. Davidson, Rev. Com. in the 4th Civil District,

Samuel H. Davidson, R.C. in the 3rd district. All of whom Made their return of the

taxable property and polls in their respective districts and oath being Made to the same, it

is ordered by the Court to be recorded.

 

Personally appeared in open Court D.P. Hudson, Rev. Com. in the 5th Civil district of Benton County and Made return of his list of Taxable property & polls in said district and

oath having been Made to the same it is ordered to be recorded.

 

On Motion it is ordered by the Court that Eli Craig be appointed overseer of the road to

work from the stage road near John D. Carnes to Cottingham's Mill, hands as follows,

Freeman Presson, James Cottingham and the hands that live at Levin Cottingham's and

Eli Craig shall work under said Craig on said road which is established in the 3rd Class.

 

Court then adjourned until Court in Course.
